Actually, all branches of the military answer to the Department of Defense, which is a government agency. Which means they are, legally, a government agency.

Good question. I agree with the previous answer. We do answer to the D.O.D. And in order for me to be in Naval Intelligence, I had to get a clearance from the Department Of Defense.
Also, have you ever seen a military recruiter's car? They drive government vehicles with government plates. Only members of a government agency are allowed to do this.

The militia in the Constitution specifically excludes federal military personnel both active and those subject to recall. The argument you are using is the same one the Supreme Court has shot down three times when addressing the Second Amendment to the Constitution. The last time was the Washington DC gun ban that basically outlawed ownership unless you were federal military, National Guard or police officers and it was over turned based on the militia as used at the time of the Constitution was the general body of the population and not federal military personnel. A second definition is given in USC 47 federal law which says the same-groups excluded in the definition of militia are felons and federal military both active and subject to being called to active duty under the federal government (meaning the National Guard). So the militia is everyone except the military and National Guard.
