what happens when your boss accidentally over pays you?
|
I recieve 2 paychecks already and in both of them I got holiday pay. I did work during the holiday weeks but I didn't exactly work on the day of the holiday. So I believe that they accidentally over payed me. I already cashed my checks. I think I should ask them to make sure but will I get into alot of trouble? They only over pay me by $150 for both checks so it's not a problem if I have to pay that back. But will I get into other troubles. Please help.

Nope. I say pretend you dont even realise it, if they find out what they did, then say woops, I had no idea, and return the money.

Ask them, you won't be in trouble. And you might have even been entitled to the holiday pay, depending on the company's policies.

Regardless of the other answers posted here, what you are doing from a purely legal standpoint is called 'wrongful appropriation' - better known by its common term, stealing. You are taking (and keeping) money from the company that you KNOW does not belong to you.
There may be a chance the company never realizes their mistake, but if later on they realize how much you have been overpaid, they can (and often do) demand immediate re-payment. If you do not pay them, then they have the right to take actions that range from firing you to firing you then going to court to obtain the money back, to demanding that you be criminally prosecuted for your 'crime' (although that outcome has rarely been accomplished).
Because of all of the negative consequences possible from you not reporting the overpayment, the best course of action would be to work with your financial section within the company to get your pay straight and pay them back any overage amount, if possible (some companies accounting systems are so screwed up, they often have no way to take money back from their employees). The sooner you straighten this out, the less potential legal trouble you have to worry about.
Hope this helps.

While I agree with all of the folks that said you owe the money back, has it dawned on you that they were paying you for holidays you had off. We called those paid holidays.

No, you will not get into trouble. The worst thing that will happen is that your employer will learn that he/she has an honest employee. They will appreciate this, and you may find that it was not a mistake after all. Good luck.

If you would normally work those days (holidays) and the job is closed then it's considered holiday pay. If that was normally your day off then it's possible your boss made a mistake. You can inquire about holiday pay just to know if you were paid accordingly.

Yes they can make you pay it back. Needless to say, your reluctance to pay back an obvious mistake will not reflect well on you and could be brought up next time raises or promotions come around.

I AGREE WITH JUDITH TO AN EXTENT. Be honest about it and let them know either way you will get pay for your work. Keeping something that isn't yours is just wrong. Don't mean to sound harsh but, what goes around comes around. Hope you make the right choice!!!!!

Playing dumb or acting like you don't know is stupid! Behaving in this manner could end your employment with them. If I were you I would go to your supervisor and tell him that after depositing both checks you realized that you might have been paid twice for the holiday pay and would he please check on it for you. That way, you'll look like an honest employee and it's far better than to have them find it and think that you knowingly cheated them. But you should have asked about it before cashing the check - that would have been better yet.
