Labor Law Question - Employer just fired me while on med leave?

I am on medical leave and have Fibromyalgia. Employer who has been trying to fire me for a long time b/c Boss is a psychopath . My work was exceptional per my customers, but boss wanted me gone, which I have extreme documentation of their lies, set ups and harassment.Now, while I was out sick (was supposed to return to work after 1 week off due to extreme constant pain) they put a temp employee in my place. They also went behind my back to tell customers of my plight...regardless. They intend to fire me when I was supposed to return to work on 5-19. However, when I went back to the doctor, doctor would not release me back until I went to phy. therapy etc.
Now, a little more back ground. Boss is stationed in NY. She actually flew down here on Monday 5-17, was at the local GA facility where I work, putting temp in my place and was awaiting my return to work on 5-19. When doctor put me on further care not releasing me back, this thwarted their plans to fire me. For several months the boss has harassed me and bullied me non stop. She did everything she could do to make it look like I was a complete idiot. God is good, b/c every attack she came at me with, I had a counter-attack, meaning I would present her w/back up evidence that her findings were inaccurate and contrived. Med leave (started 5-12-10 w/return to work on 5-19, but as stated, doctor extended leave and I was unable to return to work on 5-19.
Employer called me yesterday giving me the boot, yes I have lost my job while on medical leave. Said for me to file for disability thru their private insurance so I can be covered medical wise. They also said that if I don't get the disability, I can file for unemployment. I will be officially off their payroll on 5-28-10 with the company stating they will also give me 2 weeks severance and state that my position was eliminated. The employer stated that they would not dispute my Unemployment claim and would tell unemployment that my position was eliminated.
My concern: These people are ruthless and liars. After the phone conversation w/them stating the above. I emailed them a letter w/all stated and for them to put in writing the clause of "not disputing unemployment" etc. They have not returned the email and confirmed their plan. I do not trust these people and am in fear that If I do get approved for disability, how do can my benefits thru employer still be in effect if I am no longer an employee as of 5-28? Also, the unemployment issue...i will have to file for it but the company won't put in writing "position eliminated'. What do I do to protect me income????

The condition you refer to is disputed in the medical profession

Therefore if you accept that this is an "unofficial" condition, not widely recognized in medical circles, any employer would have the right to suspect (a) you were inventing or exaggerating your symptoms and (b) you were milking it as much as possible (extended leave).
If you have been complaining of this condition for some time (it is not a once-only thing just happening now), a UK employer would let you go as medically unfit - on the basis that somebody running a business or service is entitled to expect regular attendance at work from employees and an employee who is frequently certified sick is considered not up to the job

Were you eligible for FMLA leave? If not, there's nothing illegal about firing you even if you do have a doctor's note.
If you were eligible for FMLA leave, then the rules change. If you were off for over 12 weeks in the year, they can still fire you since FMLA protection is only 12 weeks per rolling year (365 consecutive calendar days, doesn't have to be same calendar year). If you were off less than that, and had FMLA leave, they can only dismiss you if they can show you would have been dismissed even if you had NOT been off on leave.
If you're medically unable to work, you aren't eligible for unemployment - those are government rules and have nothing to do with your company and whether they contest unemployment.

firind someone based on disability is illigal in the US--and from I hear in the UK too..
going on medical leave in accordance with FMLA or allowable sick days is not excessive absences and in fact reasonable accommodations may be allowing a few extrs unapid sick days
Fibro is reconized by all comeptant doctors..and in the US, people do get SSDI for it
you can look into filing a FMLA complaint (were you officially on fmla--if not write a letter stating this immedicately)
you can try a disability discrimination compalint--but you need to show that this was done becuase of your disability..did you request accommodations and were refused? from what you stated you have a weak case
and don't depend on the EEOC to help--they ignore 91% of cases and screw up another 4.5%..
and lawyers won't take these cases on contingency since they are not profitable enough for them
but don't depend on the EEOC to care
if you have a short term disability insurace--you can apply for that and when you are able to work--switch to unemploymnet
