Dismissal (Gross Misconduct)?
Is there any one who, having been dismissed for gross misconduct, was able to find alternative employment? How long did it take you? And if you were initially successful, were you still working for your new employer past the usual 3 month probationary stage, when presumably, your new employer had received you references from your former work place?
I have found myself in the situation of having been dismissed for Gross Misconduct. Having only been working for the company for less than 6 months I am aware of the non-existance of legal rights.
I strongly contest the circumstances which are suspicious and have been capitalised on immensely, just so that the company does not have to pay me 3 months notice
I have appealed although I know that this is futile as the Manager chairing the appeal, is the same person who was overheard by a colleague (pre disciplinary hearing) to have said "Sack the bast*rd. I want F@ckin' rid".
I have had an unblemished work record spanning 20 years!

Yes I was fired for GMC half way thru my probation in my last job for having an argument with a colleague and then swearing at them, this complete **** wound me up and it was their fault but the manager took their side and of course, no reference. I was unemployed for 6 months and used the reference from my previous job. I removed the job from my CV and lied saying I went travelling in Australia as a "career break" for 6 months.

I worked for one company (interior design/architectural firm) where I had 2 bosses...the owner (female) & the vp (male). I was "let go" by the vp because I didn't have enough education to keep up with the rest of the staff. The owner lied to the unemployment office by telling them I was fired for viewing porn and chatting on porn sites on company time.
Anyway, I left them on my resume because of the work experience. ..but on my references I put the vp's name, not the owner because I knew she would give me bad report. I didn't have any trouble finding employment, out of work for only 1 week.
What helped me immensely was delivering my resume to the next employer in person. They actually called me back that same day for an interview. ...and I started the same day as my 2nd interview.

You don't say what work you do, but you sound like you're relatively senior and experienced. Unfortunately this causes two major problems for you:
- It will take you longer to find a job anyway, regardless of your reasons for looking (i.e. even if you hadn't been sacked), than it would someone in a junior role
- Presumably, what you are accused of doing is very serious (i.e. it's not like you've been accused of pilfering £20 out of the till, which a future empoyer might overlook)
Therefore, you could receive 25 answers all telling you that other people in this situation have found a new job easily, but I have a feeling that this is not going to be the case for you.

I would recommend that you try to find jobs through former colleagues or friends (i.e. get them to refer you for positions at their workplaces), as these people can vouch for your good character and explain that your dismissal was a misunderstanding. Of course you can explain this yourself, but it's obviously more credible coming from someone else. It's all about networking. Don't be shy about calling people who you haven't spoken with for 5 years as long as you think they'll remember your name. If you're not sure whether it's appropriate to call a particular individual or not, try finding them through a networking site like LinkedIn and then contacting them through there.

Also, I don't think you should be waiting for your references to tell a new employer that you were sacked for gross misconduct. This is something that you should divulge yourself during the application process (they will usually ask you what your reasons for leaving your last job were). If you explain earlier, this gives you a chance to get your side of the story in. Leaving it until references are checked makes it appear that you are hiding it and therefore must be guilty; and in fact, you have been dishonest if they did ask and you didn't tell.

Definitely continue to contest the situation with your former employer. Have you contacted ACAS for advice? You definitely should if you haven't already, and they will inform you of how to take the empoyer to a tribunal should the need arise. Even if you never get the money for the three month notice period, you can hopefully get your name cleared to prevent them from telling a potential future employer that you were sacked.
