You seem to be asking me what your lease says. I have no idea. If you are asking if there is some law that forbids you and the landlord from agreeing to a lease that calls for more rent if your kids move in, there is no such law. You are free to enter into such an agreement if you wish.

No, not if you live in a commercial apartment complex. You pay for the square footage, and not for the number of occupants in the unit.

Depending on the size of the unit you now live in and the number of children you have, it would be legal for your landlord to require that you move to a larger unit. City ordinances and fire code may restrict how people can occupy one unit.
