Is it legal or illegal to fire someone because they are homosexual (Please read-I live in Ohio by the way)?
|
I've realized that at the job I work at everyone is pretty close, and in that comes personal curiosity about everyone's life. People talk about their marriage, who's dating who, ect. I work in the food industry and even the manager's let it be known if they find someone who comes in attractive or not. Most of the employees are male and they really like to talk about sex and stuff. They don't actually go into detail but everyone is weirdly interested in everyone's sex life.
I know this is unprofessional. I don't say anything though because it's just not worth it. So in this whole situation inevitably they've been interested in my personal business. They ask me if I like certain employees or they let me know when someone attractive is coming in. The thing is I am gay. I just go along with the whole thing because I don't know if I told them I'm not into girls if it would get me fired or not. If I tell them I don't want to talk about my personal business they would just think I'm a prude or I am gay anyway. It's so frustrating to have to hide this. If I was out at work it's not like I would be making it known to everyone all of the time (but the heterosexual people at my job make it know all the time about their personal life and sexual attraction or whatever so I hate this double standard). I hate putting up this fake persona to prevent drama or even isolation or perhaps termination from happening.

Yes.
The EHEA prohibits discrimination based on sexual orientation or gender identity in employment, housing and public accommodations in Ohio.

It is probably best to stay quiet. I don't think you would be asking this question in the first place if you were sure of their reaction, so you should trust your gut if you sense it is risky.
They could discriminate against you for promotions or layoffs and the like if you tell them. It doesn't matter what the law says, if they discriminate in a very discrete way, without actually coming out and saying "because you are gay" then you just won't have any proof to dispute it.
I'm sure you can dodge personal questions without lying, like "do you have a girlfriend?" just answer "no."

The following states prohibit employers from firing employees due to sexual orientation: California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Iowa, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Hampshire, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Washington, and Wisconsin.
Since Ohio is not on the list, it would be legal for the company to terminate you for homosexuality.

It is illegal but be advised that employers can come up with trumped up reasons for dismissal to cover a firing due to sexual orientation.

Ohio does not have an anti discrimination law for gay employees in the private sector. But your employer may have a human resources policy that forbids such discrimination.
I am gay and there isn't a one size fits all answer to this. You could smile and say, 'Sorry I don't kiss and tell." IF someone cute comes in then you can recognize beauty in women even if you are not into women. You can say, "Yeah she is beautiful." and leave it at that.
One final thought...anti discrimination laws can protect you if you are fired. But homophobic employees can make your work life miserable even if you don't get fired.
