Does having a gun in the car warrent a search of a locked trunk?
On my way to the shooting range with two friends I was pulled over for bad tags, I immediately informed the office that there were firearms in the vehicle. I am an informed shooter and was obeying the laws in regards to firearms transportation and attempting to cooperate in every way. Even so, he drew his weapon and threatened my life while cursing at me with his gun sideways clearly trying to intimidate me. He never asked for my papers or any other information, called for backup, and began treating me like a terrorist. 14 officers had their guns drawn when I was finally told to exit the vehicle. I sat in the back of a cop car in cuffs for well over an hour while my vehicle was searched without permission and was made to look like a criminal in front of my friends and neighbors. Nothing was found and I ended up with just a fix it ticket. When I asked for the shift supervisor I was told he was not available and I would have to talk to someone else. As I spoke with that man I felt that he was very evasive and just plain disrespectful. I asked to file a complaint and was told the officer would contact me. He has yet to do so.
Additional Details
I live in California and when I say I’m an informed shooter I mean that. The guns were locked in the trunk and the ammo was upfront in a case. All guns, mags, and ammo are California legal. We are also of legal age.

i would go from supervisor to supervisor and if they are all like that then it might be a departmental problem. write your congressman and the state attorney, i would even go as far to write your governor.he clearly had no reason to treat you like that by what you have said. there has been a lot of cases like this where police have done the same. in california there was such an incident but at a mans home where the cops responded to and where caught on their own dash cams saying that they would find anything to get him and that no matter what he was going down. it turned out he was sighting his unload rifle in his own yard in a rural country property. anyways they completely violated his rights and did the same thing to him as they did to you but they actually confiscated his guns.
--- main point write and write and try to find a civil rights lawyer that will take your case. there are too many police that act like that and itsridiculouss and completely un american. i am a criminal justice major and plan on going into law enforcement myself and it makes me sick to see police officers that act like that and ruin the name of the police. thats why kids think cops and their enemies and any officers that act like that and tarnish the name of police should be fired and imprisoned.
----- persue this with absolute respect and professionalism otherwise no one will take your seriously and you will be disregardedd as a liar who hates cops.

You need to go to the station to file the complaint. If they give you the run around, then contact a lawyer and sue the crap out of them.

Your mistake was volunteering the presence of the guns. As soon as you do that, the officer has to Take Notice, his paperwork load goes up drastically and a simple traffic stop becomes a Big Deal. In short, you ruined his day and that pissed him off. Even so, it sounds like you got off easy. Legally, the officer can impound your guns for up to 48 hours to make sure they weren't involved in any crimes. Practically, once that happens, getting them back is a major hassle, so consider yourself lucky.

I work with police officers from time to time and they all tell me that, on simple traffic stops, all they want to do is give you your ticket, or whatever, and get on with their day. They Do Not Want To Know if you have guns in your car (unless, of course, you plan to shoot them). The unofficial policy is "don't ask, don't tell." If they don't ask, you don't tell and everyone gets to have a relatively simple day.

I own a number of guns in California, which means they're all registered. The list of them comes up on the computer in the squad car even before my vehicle registration information, so the officers know who they're dealing with. No officer has ever asked me if I had guns in my car, period. They just deal with whatever caused them to pull me over, we both go on our way, and that's the way they like it.

So, now you know what to do the next time you're pulled over for a traffic violation: Keep your hands in view. Don't make sudden moves. Be polite. Don't volunteer any information you weren't asked for and, above all, don't talk about guns.

This sounds like a joke. 14 officers? Don't believe you. Did you tell him you had target weapons in the trunk, or did you say "I've got a gun on me" or something equally threatening?

I don't believe you even spoke to an actual police officer, because no trained officer (as you would know, if you were an 'informed shooter' would ever brandish a gun sideways. That's a punk ganster move, not something any trained shooter would do.

I know you're mad but i didn't need a story, I need facts.

Not to be a prick but it helps to know what state your in, to ascertain if it was legal for you to have a HANDGUN inside the car. It would also help to know if you are required to have a Conceal Carry License or if you do.

If you had a CCW, it permits you to carry (A) gun, other gun(S) should be in the trunk. If it was a rifle, it should ALWAYS be in the trunk with the exception of a, and again it would be handy to know, few states.

Did the officers tell you to or did they put the guns in the trunk? If not, sue the living sheet out of that department and that fukkstick Nazi officer.

I suggest you do exactly as they say, " contact the California Department of Justice at 916-227-3703." ALONG with a lawyer.
Don't expect much though, you are in Kalifornia and cops RARELY get punished for such behavior. I'd also suggest the ACLU but unless you're Black, Mexican, Gay, any combination of the afformentioned or a Communist...........they won't help you although THEY SHOULD.

That cop was way out of line and you should so inform the authorities. He had a right to see inside the trunk, primarily because you admitted to firearms possession. But the rest was uncalled for.

If you're driving a car illegally then the police are naturally going to be suspicious of your intentions with your guns. You can't say that you were being responsible as far as transporting firearms because you're transporting firearms in a vehicle that wasn't legally registered.

What state are you in? Call your local police department and ask how to file a complaint against an officer. You don't have to answer anything per say but they should tell you come in and fill in a complaint. But I honestly think you should get a lawyer. Also try to contact the CHIEF OF POLICE.

Also they can search your car with probable cause, But you told them that you had legal firearms in the car and he drew he weapon on you. Especially if you cooperated.

The incited was handled very poorly. Don't wait for the officer to contact you to file a complaint. Take it directly to the municipality. If what you are saying is true your rights were violated. You weren't breaking any gun laws and the ticket they gave you was trivial.

When a driver of the vehicle voluntarily tells the officer he has guns in the vehicle, there is no reason to believe the person is an immediate threat. If he had evil intentions he would not volunteer that information. I don't know if the police have the right to search a car because it is unregistered. But even if they do, the stop was very unprofessional.
