Can My Friend Be Charged For Anything?
He stole his parents car a few times and eventually he got caught by his parents when he came back home. needless to say that hes grounded, but they keep threatening to press charges against him. the only proof they have is kind of like a statement from him, is the way he described it. he had to write an apology letter and he did say "I'm sorry for stealing your car" in it. On The back of the statement was his groundings written out and then under that him and his parents all signed the back of the paper. is there any way they can use this paper against him in an actual court to charge him or are they just trying to scare him?

If it makes any difference, its NY, and so far no authorities have been involved

They cannot charge him because there is no private criminal prosecution in the u.s. If they turn the paper over to to the cops, the DA can charge him and can use his confession against him. There is also the testimony of the parents. They are witnesses to him coming him with the car, and witnesses to his lack of permission,

They will use it just to scare him. Parents actually dont send their kids to jail even though they may need it.

They're just trying to scare him. Especially if he lives with them. If they wanted to really get him into trouble, they should have reported the car stolen when he had it. It's much harder to make a legal case against him if they didn't report the car stolen. It's still wrong, probably still illegal, but the police aren't likely to take it seriously if it happened weeks ago and they're just complaining about it now.

Technically, no his parents can not press charges against him. But they CAN file a police report about his taking the car without permission. It will then be up to the prosecuting agency whether or not charges are filed. As for the written statement, it may or may not be allowed, depending on your state's code of evidence and the factual circumstances surrounding his writing.

now that he has put it in writing they can take it to the police and let them follow up with any charges.........what I think they are doing is [as a parent my self] is making dang sue that SHOULD he be stupid enough to do it again they will without hesitation report it stolen and and that good stuff that comes with him breaking the law once again, after all they have it in writing that he has already set a precedent for doing this.

They can file a criminal complaint against him. It would be up to the prosecutor as to whether to file charges. The case would turn on their testimony versus his. He would be toast.
