is it illegal to go through someone's e-mails? (as in hacking)?
either explain what is the worst that can happen from a legal's point of view, or choose on of the following statements.
A - illegal if you use the information against them
B- illegal for others, but not if you went through your spouse's e-mail
C- not sure at all
D- not illegal but morally wrong
E- you could pay a hefty fine/go to jail, if the person finds out
F- living in separate houses, but still legally married, then you have every right to go into your spouse's e-mails.
G- other

It is an offence, you are pretending you are that person. If you then obtain services and monies with that persons details it is fraud. Depending on what you do, there are a whole range of offences under the Fraud Act 2006. Also you may be in breach of the Data Protection Act 1998 and you are also infringing the persons Right to Private Life according to the Human Rights Act 1998. It's like if you open someones mail addressed to that person only.

Your ex may well take you to a court in both by way of making the allegations to police, as well as in a civil matter.

So A-G applies and yes it is wrong. However if you and your spouse share the same email account and has the same log in , due to a mutual arrangement, then you are technically allowing him/her to read emails that come into that account.

I suggest you Google the Act that I have mentioned above for more guidance.
And don't do anything stupid, no matter how angry you are...

Logging onto to another's email account is identity fraud.

It is never legal to do this, even with a spouse.

hacking another person's e - mail is identity fraud
even if it is your spouse, it's very wrong, and once he/she finds out, he/she would/ could charge you for it
