Tracey Seth	Federal law says that sex between two people under the legal age of consent, is not consensual when there are more than four years difference between the ages of the participants. The only way the federal law would not apply is if the state law is more stringent and reduces the number of years between the participants. dm_felionous	In Ohio a minor over 13 can legally consent with a person under 18. So 12 and 17 is no, 13 and 16 is yes. I am not advocating it just letting you know what the law says at least the last time I checked. These laws vary greatly from state to state and of course if state lines are crossed than that changes everything. Added: States set their age of consent. Federal laws come into play if someone crosses a state border or national border. They also apply to pornography. Within a state there is no federal overruling for age of consent. However there exists a close in age exception where an offender can be charged only if 18 years of age or older.
