You must be Blonde. He meant by escaping. If you actually kill a guard, you normally get the death penalty, not released from jail.

I suppose killing a Guard could aid in someones escape, however they would never stop looking for the person that done it and when they were caught, they would probably be Tried, Convicted and Executed.
