are prisoners released if the laws change?
I'm just curious and this may seem like a dumb question but I can't find the answer. If, for example, marijuana is legalized, will all the people in prison for marijuana related charges be released or will they be held to finish their sentence? I know that because of "ex post facto" if somebody does something that is legal and then the laws change after the fact, he can't go to jail. I was wondering if it goes the other way.
Some laws a retroactive and others are not. It is like a small town can in-act laws in the about animals but some people are grandfathered in because they had animals before the law. The law only stop people from bring in new animals?
Some prisoners have other charges and are not effected but may receive shorter sentences?
It depends on how the new law is written. But in general no. The person broke the law at that time and was sentence to x, that fact the law was later changed has no bearing on what the person did at that time.
