Our lease ended and were supposed to be out by the 15th. My ex-roommate had moved out about three days before then, and I left on the last day. They left a small machine($1400 value) in the garage so I had to get it out also. So was packed with the rest of my things. Later she texted me that I stole it and had it without there permission( I moved 2hrs away). So filing charges against me is what they did (supposedly). Im not sure what she told the police but would my situation be considered stealing? Also, they owe me money(1k) and was planning on giving it back when I come back in town to receive the money.

sounds to me it is quite possible you took it as ransom for the money you're owed. And yes that is stealing. But I don't think you have much to worry about

Regarding the item, if the authorities show up, explain the situation. Do not under any circumstances though mention that you were holding until you got your money. By the sounds of it you took it thinking she had left it behind more than anything and wanted to make sure it was returned to her. So she should be thanking you that you didn't leave it for the landlord, cause once the keys are turned in the property left is theirs and disposal cost could have come back on both of you if they didn't want it.
So when you bring her the machine, give it to her. Then bring up the money, as you can't hold her property unless there was some agreement prior for you to do so ie collateral. Make sure you have a witness, preferably a unbiased one; someone who is not close to either one of you. Then if you need to file small claims, you will be in better standing cause you didn't break the law. If they bring up the machine, tell the judge the above situation and that it was returned with no conditions on the money they owed you.

no its not stealing, she left it behind, and you were taking it for her. i would just say if she forgot it, then let her have it, its hers. but make sure you gets the $ she owes you. tell her she gets the machine when you get your money. fair enough.
