What can be done if the police refuse to do anything about an assault?
Four of our staff members were assaulted by a child. He's Autistic and has kicked, bitten, and beaten three teachers in our building. I believe every child should have the right to attend regular education classes unless difficulties arise that cannot be overcome, so I have nothing against a child who is Autistic. However, he's made several death threats, thrown staplers and books (which have hit staff members), and one of our teachers is going to physical therapy because of being kicked extremely hard in the leg. We have a good staff and everyone's trying to help the child, but he's completely out of control. This has been happening for four months. Back in November, one staff member filed chargers against the child. The police refused to contact the child's parents and haven't done anything about the charges. Honestly, it's a bad situation and no one knows what to do. If anyone has any advice, please feel free to answer or add suggestions.

It sounds like all you can really do right now is 1) create a paper trail by filing a report every single time there is an assault, and 2) filming the assaults for purposes of documentation. Down the road, you may be accused of being at fault, and you will want (need!!) to have the paper trail and any other evidence ready and waiting.

You can sue the assaulted in civil court for damages.

What is the principle doing about it? Don't tell me--Nothing!! There's a shock! (I taught in the inner city so I know what you're going through.) If the child is under 10, they can't be arrested in most places. All they can do is start a file. However, both the principal and the central administration need to be doing something. Further, you should have a union that you should be contacting, though I realize they don't do much, either. I know in our contract, when I still taught in public school in the city, we had a clause that stated that the district was expected to provide a safe working environment. Obviously, the district isn't doing that so it's a breach of contract. Make it clear to the union it is. Make sure you document every action that has taken place and every action you've taken to respond to it. The lawyer will need the information.

Good luck! It sounds more like a no win situation to me. That's why I left after 7 years and will never go back into the city public schools.

Now, tell me....you've HAD meetings with the parents, plural, and they just aren't interested. The principal WON'T allow you to suspend him and the district WON'T expel him.

And, for the record, officer, not all autistic people are incompetent to stand trial. There are levels of autism.

Perhaps the principal and the concerned teachers should schedule a meeting with the child's parents and relate your concerns to them. There may be other factors at play in addition to the autism that could be causing the child to act out. Tactfully, suggest to the parents that the child see a behavioral therapist might help. Otherwise, let them know that the current behavior cannot continue as they would have to find other schooling for the child.

File a restraining order on the family and let them know that you will not continue on with teaching this child under those conditions that it not only puts you and your staff at risk, but it also endanger other students. You should be able to stop the child from being able to come there if he is causing danger to others. Contact a lawyer, A lot of them will work on a contingency bases. In other words the case can be heard by them with out costing you anything. You have rights. but so does the child. but the main factor here is he puts others at risk with his behavior.

There is little do do about it if the police refuse to do anything about an assault. Unless you are of higher power then the police or if you contact someone who is higher ranking then a police officer. I don't know if you are a christian but if you are it might help praying. The simplest solution would be to just keep contacting the police until they do something about it. Good luck with the situation, I hope it gets better.

I think it's time to expel him from the school. He clearly needs more in-depth help than you can provide, and I'm sure it's disruptive to the other students. Call his parents in, and tell them they'll have to enroll him elsewhere.

I know you want to do the right thing, but this situation is dangerous!

If this kid is at your school, how do you not have the means to contact the parents yourself?

Just the same, if the police are not responding to the request for charges, get a lawyer. It's just that becasue the child is autistic, he will not be charged, his parents will. Which is why I would do what you could with the childs parents first.

Criminal charges cannot be filed against someone mentally incompetent to stand trial. End of story. This is a school issue, NOT a police issue, the school needs to move him to a school that is better prepared to handle his needs.

Well goodluck, although I am fully aware of the fact that there are varying levels of autism, I don't arrest mentally handicapped children due to incompetence in supervision...and by the way the police seem to be treating this situation, this is most likely the case. :)

....also, how would you go about suing the "assaulted" in court?
