Under what conditions can an Officer release his K-9? & Another K-9 question.?
Ok these questions are because of the fact, we drinking on a public park late at night, its barely even a park its about 50 ft wide with a bathroom some grass and a bench. But it turns out we were trespassing on public property. The Officer first on the scene was a K-9 officer, he pulled up with his lights on and did not say anything. So we started walking away, thinking he was just kicking us out, and he screamed over his radio "Come here or I'm going to let my dog out on you!!" and we were harrassed and searched like usual through the whole process he kept threatning about letting his dog loose, he even said over his radio that someone fled the scene running to inspire lots of officers to come and the sargeant, when the whole time we had no clue anyone left, because it turns out no one did.

Also when you get pulled over and you deny search upon request. How long can the officer hold you for the K-9 unit to come or for warrant?

Don't relate the second part to the first they are similar but the details only apply to the original question. For the second question I am just asking if you have a regular traffic stop and he asks to search your vehicle and you tell him no does he have the right to hold you there for up to 24 hours to either obtain warrant or a k-9 unit. Can you pressure the officer by asking him am I under arrest? and telling him ok if I am not under arrest can I have a citation for what I have done wrong if not either then I am going to be on my way..

He can release the dog anytime after he warns you. Once you refuse a search, you can be held until the K-9 unit gets there to do a walk-around. No time limit. He won't need a warrant once the dog signals anything. This signals "probable cause". He does not need a warrant OR the K-9 to search your person. It is considered a safety issue.

just because someone is a cop doesnt mean they know the law or how to enforce it.

A Terry stop allows for you to be "pat down" if there is a reasonable and articulable suspicion that the suspect is armed or engaged in criminal activity. A stop, in and of itself, does not subject you to a "pat down" under Terry v Ohio. Being in a park at dark does not constitute being armed or being engaged in a criminal act. Matching the physical description of a suspicious person does not allow you to be "pat down" under Terry.

You do not have to provide a driver's license, you may verbally identify yourself in compliance with the officers request for identification. You may refuse to identify yourself, a request for ID is simply that, a request.

The question to ask is- "am I free to go?" They can briefly detain you for various purposes, but they can't hold you unless you're under arrest. If you ask "Am I free to go?", and they say no, ask "Why not?" or "What is the law that allows you to hold me?" or "I'm not under arrest, yet you've said I can't leave ... please clarify my legal status at this time."

If you are not under arrest and being detained unreasonably long- call the state police, ask for their supervisor to come to the scene, call an attorney.

K9 can be released after 2 proper warnings has been issued in a normal circumstance.

Police can hold you for up to 24hrs without charging you with a crime.

If you are stopped by an officer and you do not comply with his request for identification he does not need a warrant to search you. Under Terry v. US. (or was it US v. Terry), police can conduct limited searches without warrants.

Here, two such situations are presented. One, failure to identify yourself to an officer gives him reasonable suspicion that something wrong is happening, and gives him the right to conduct a reasonable search until his suspicions are cleared.

Second, if a police officer has lawfully stopped you (and drinking in a park, or even being in a park after dusk when the park is closed, gives him lawful right to stop you) then he can conduct a limited search of your person to determine if you have anything that can hurt him, i.e., a weapon. If in the course of the weapon check he finds anything else illegal, well that is fair game.

The 4th amendment isn't as absolute as you think.

You weren't being "harassed", you were comitting a criminal offense and he was doing his job.

A K-9 can be deployed per department policy. The situation you describe; late at night, with mutliple criminals (ie you and your buddies), refusing legal orders is a prime example of when a K-9 should be deployed.

Your another question has been asked repeatedly, use the search function.

EDIT-great answer jsid96, apart from the fact it has nothing to do with this question. Chase was committing at least three crimes by his own admission...so he's NOT free to go, until the officer decides. How about actually reading the question before sprouting your "expert" opinion.

Since you admitted to being in the park after hours, you had committed an offense that allowed the officer to detain, now for his own safety he is going to search you, this you call harassment, this we call doing or job so we can go home at night. 99 percent of the police departments do not allow k-9 handlers let the dog loose from the leash, and next to certain 99% of the time the dog gets away from the handler by accident. I would stay out of the park and vehicles that transport drugs and you will be fine. There is not set amount of time, if you are not in possession of illegal substance, I would wait just to make them mad.
