Police would not file my police report, what can i do?

Damages caused by a traffic collision are a civil issue and are handled by your respective insurance companies. Police agencies are required to take a report regarding a collision in cases where a separate crime occurred (i.e. hit and run or DUI) or major injury collisions (fatalities or parties being transported by ambulance away from the scene) as a matter or law. Departments are free to set policies on whether or not to take police reports for non-injury, property damage only collisions. Since there is no legal requirement for departments to take a police report in cases like yours, most major departments don't. This is a decision police departments make because their time and resources are limited, and because a civil structure (your insurance companies) already exists to remedy the problem. The police exist to protect people from serious crimes and assaults - not to play the blame game in fender benders. You don't mention your own insurance company in this scenario, just the other drivers. File a claim with your own insurance company and get the problem taken care of, thats what you pay them for. 2009-02-25 22:31:30 +0000	in some states (including mine), there is no report filed if it falls under a certain amount of money. usually they go by the "eyeball" factor, and just eyeball the damage to deem it reportable or not. this is to keep them from doing a report (time and money costs) for every $10 fender bender. however, a citation should have been issued. however, if both of your stories were different, and with no evidence to the contrary, they just can't pick a side to go with. YOU could have changed lanes and hit the other person. Did you have a witness? if not, the cops hands are tied. you can always file a lawsuit in small claims court. Was this answer helpful to you?
