They will revoke his probation, but they may give him time served if he has been in jail a while. His attorney may be able to get the charges reduced (plea), there is no guarantee on anything. But burglary of a habitation is very serious crime. He will more than likely see some TDC time. It is a second degree felony. The owner of the habitation could legally use deadly force to stop a burglary, your son may want to find a less hazardous line of work.

It is the your sons right that he will be represented in a court of law(gideon vs wainwright). You can hire a new lawyer for him but that is up to you. As to sentencing, I am not sure.

How old is your son?
Hire an attorney to LOOK over the work to the state appointed attorney. That should be cheaper. Better yet, first, you LOOK over the work of the state appointed attorney.
You may have to get "power of attorney" forms filled out by your son.

He definately needs a lawyer.
Second charge on burglary = jail for quite a while.
Is he using illegal drugs.?
This is a common reason for burglary.
He may be able to go to rehab. instead of jail.

it depends on how old he is
he will be charged with burglary and could spend 1- 3 years in jail

If your son is convicted of burglary of a habitation he could get 2 to 20 years in prison. It is a felony of the second degree. Texas penal code 30.02. You need to hire an attorney if you can afford it. I am a retired cop. I know. Good luck.

He is entitled to legal representation...either hire a lawyer, or he can use the PD. Sounds like he is a loser who could use some jail time.
