How can I ask a distict justice to throw out my driving under suspension?
|
I was caught driving without a license in Pennsylvania, my home state. I went through a 3 year period of my life where I had 4 of these offenses. I am 33, and I have not had any violations in 3years nor did I have any prior to age 27. I pleaded not guilty just to ask the judge for sympathy. I am on the right track, and I am in line to make a big career move. However, this would end any chances for this career move. I cannot afford this. What should I say to the district justice? I would be willing to take a larger fine, without the driving violation. I need my license back. Additional Details Just to add that I was not pulled over for a breaking a traffic law. I went through a DUI checkpoint and was immediatly cooperative upon approached by an officer.

A district judge will likely have no sympathy you alone in the court.
Your only chance is to talk to the prosecutor before court (if the specific court allows that) or a hire a lawyer to represent you. Either, it is going to cost you a mint.

You could try to go to the DA before the court date to make a plea bargain. He will want you to plead guilty. Depending on how long it is until you are eligible for reinstatement, and depending on your previous legal history, he may agree with you. Good luck.

You could try getting a letter from your employer stating u require the drivers license for work.
But u take the risk of disclosing to your employer what you have been up to. You would need alot of groundwork to be done with your employer to write a letter on your behalf.
But ultimately, it would help your case.
It shows a character history. In turn showing the judge, that there is someone out there (your employer) who does think highly of you and the work you do for them.

I hate to be the bearer of bad news, but you don't have much chance of a positive outcome here. When you go to trial, the MDJ is going to have a copy of your driving record, and when he sees that you have a history of the same offense that you are charged with now, he isn't going to feel much sympathy for you. There is always a chance that he may grant you some leniency but just prepare yourself for the worst.
You need to basically beg the judge for mercy.
Also, you are obviously committing some other type of traffic offense to get pulled over for them to find that you are driving on a suspended license. If you are going to drive without a license, it's usually a good idea to obey all of the traffic laws.
