Ash	There needs to be actual proof of the rape. If a woman accuses a man of raping her the police have to investigate it but cannot arrest unless there is solid proof to charge him with rape. Her word against his is not proof enough ... And as for the person who answered about police just basically throwing their power around. My husband is a Constable with the RCMP. They aren't allowed to just to arrest people or throw them in jail for the hell of it. They to have people higher up to answer to. You should educate yourself on topics before you answer. unknown	Yes she could lie. However that is very rare to happen. Also the police will not press charges if they notice the woman always changes her story. If someone is lying then they cant keep a detailed story straight. It would never go to trial. Even if she could convince the police and DA she was telling the truth it takes about a year before the man would have a trial. So 1 year later the lady would have to repeat, exactly, the same lie again which is difficult. And it would be her word against his. Old Cynic	No, to be convicted of rape there needs to be proof beyond unreasonable doubt that the rape occurred. This means that there must be proof beyond reasonable doubt not only that vaginal, anal or oral penetration actually occurred, but that it was non-consensual. There can even be genetic evidence, but this merely proves sex occurred, and not that it was non-consensual. If a claim of rape is made falsely the woman could be charged with wasting police time, perverting the course of justice, or perjury - all very serious offences.
