im 17 years old. i was riding with my two friends up to a family bbq. i was sittin in the passengers seat. We got pulled over because my friend didnt signal 100ft before he turned, and it was BS because we pulled out of a safeway parking lot and not even 20 ft from there we had to take a left at a light. The cop saw my friend adam had a redcup in the back seat which he was drinking gatoraid out of, but i had brought it from my house to share my bottle of gatoraid and i was sick. The cop only had me breath on him because it was MY red cup from my house, tho i wasnt drinking out of it. He said it smelt like whiskey and coke. which im guessing it was used before from my dad, or one of his parties. The cop went thru about 5 breathalyzers and i didnt blow a number. Earlier that day my mom had let me drink a smirnoff and 6 oz white wine, and thats probably why i smelt like "whiskey and coke". then the cop told me to get out of the car and arrested me for MIP, even tho i had NO alcohol on me, and didnt blow a number. After i was arrested he asked me if i had anything to drink and told him about my mom..which is legal because it had happened at my house with her premission. I live in the state of washington..and this is my first offense.. Will i get my license taken away if i do diversion? Or should i try to fight this? because i'm innocent...and the cop told my mom that i would just get a slap on the wrist and not even get an MIP.. im so confused...

it was the last day of the month too so im sure the cop just need to get paid or something..

if i fight it will i need whitness's? because the kid that was driving is in Alaska now, and i dont really know the other kid..
