ok well i had a lady hit my car thought the damage is only cosmetic will my insurance company still allow me to carry the declared total car on my insurance or will they tell me that they cannot carry a totaled car thus the car will not be allowed to drive legally on NC roads?

If your going to keep the vehicle your insurance company can & most times will allow you to keep less a salvage deduction. You may want to check with your local Dept/Motor Vehicles. There are a few inspections that you usually go through to get the vehicle legally registered again.
A lot of insurance companies will still cover the car, as long as it passes the inspections put forth by DMV & CHP
I'm not sure the exact details, but my dad had an accident like 10 years ago.. and his was declared totalled. He was able to bring it in and get it fixed and then rebuy it. Then you gotta go down to the DMV to get a new title. I don't remember the term for it, but it can be done.
Don't assume it's all cosmetic damages, cuz they wouldn't total out a car w/ just cosmetic. There might be other damage you're not aware of. I think you need to have a mechanic sign off on it that it's safe to drive anyway, so bring it in. Tell them you don't want to spend the money right away to fix it 100% as long as its safe to drive.
Call your local DMV to get more details. Each state might be different too. We live in NY.
