Statute of Limitations - Texas - Auto Accidents?
So, I was just contacted by a lawyer, saying that I was being sued for an accident that I was in over 2 years ago. I was wondering what the statute of limitation in Texas for auto accidents was and what that entailed. Does the person just have to file suit against me or do I have to be notified? It was definitely over 2 years ago at this point. March 2006 is when the wreck occurred. So, I was caught a little off guard when his lawyer contacted me. Thanks in advance.

Generally, the statute of limitations for both personal injury and property damage in the State of Texas is two years. It is possible that a lawsuit was filed, but you were never notified of the suit. In this case, you are going to need the help of a lawyer to sort out the facts. In most states, the Statute of Limitations must be affirmatively pleaded in answer to a lawsuit. If you were insured at the time of the accident, contact the insurance agent or company that covered the car and you at the date of the accident. They will provide a lawyer to aid you, if they had knowledge of the accident after it happened.

The Statute of Limitations for Texas is 2 years for both property damage as well as bodily injury.

Its possible that the other person filed the lawsuit prior to the 2 yr mark, and you are just being notified now.

Contact your insurance company right away. If there is a suit pending, they will represent you in court.
