Dose the party at fault's insurance have to fix my car.?

My mom just got me a new car. My 23 year old boyfriend (licensed for 6yr) took me out on the road to practice for my license. I was driving and had the right away and another driver flew out of a parking lot and smashed into the side of us. What I am concerned about is that I didn't have a copy of my permit on me and the car was so new we were still shopping for insurance. Will the party at faults insurance still have to pay to fix my car.

At least you and your boyfriend are OK. Cars can be fixed or replaced.
Since the other party was at fault, their insurance will have to pay. Notify your mom's insurance company that there was an accident and tell them the circumstances and give them the police report number and the other driver's information and insurance company.
Your mom's insurance can either handle the repairs and bill the other insurance company or the other insurance company will handle themselves.
If you were cited for not having your permit, you should be able to take your permit to court. As long as it was valid on the day of the accident, they'll probably dismiss it.

It depends, there are states that are "no fault" states, that means that you're insurance must pay for your repairs....crazy, isn't it!
If you don't have insurance on the car, depending on your state, you may be in big trouble. Where I live it's an automatic loss of license.

If YOUR car was an addition to an existing policy, it's automatically covered for at least 30 days, but after that, it won't be. If it's not an additional car, it's not covered, and you may have issures with the BMV, like a suspended license/permit.
As to not having the permit with you, the advice about taking to the court hearing is good; you should get out of that one.
