Can I press charges on my wife for stealing my car? Not in her name, only mine.?
My wife (soon to be ex) took my project car, which was NOT meant to be driven, since it had no insurance or registration and crashed into someone overnight without my knowledge. She had no license, and she went to jail but was soon bailed out by her parents. Now my car is impounded and I can't afford to get it out. The car is in MY name, can I hold her responsible for payment to the impound? Can I press charges on her?
Also, what is the likely result legally for her crashing an unregistered, uninsured car while driving w/o a license? Please tell me she'll go to jail.

The only way to find out is to call the police and ask them.

There is not enough information to answer your question. Does you wife live in the same house hold as you? Any legal separation papers filed? Where are the keys to the vehicle kept? Did she have her own key? Has she driven the car before? Did she have a reasonable belief that she could drive the car? Why did you not call the police and report the car as stolen when she took it/you first noticed it gone?

The biggest problem is not your wife going to jail - but the insurance company for the car she hit coming back after you and her for repayment for the damage to the car she hit. Now, if the car was stolen at the time - then the ins co will not come after you. But you will have to have a police report that says the car was stolen. Since you did not report it stolen when she took it but rather waited until after she hit someone - you may have a hard time getting the police to believe it was stolen - esp if your wife does not say she stole the car.

First, you can't afford to leave your car in impound, assuming you want it back now. Storage will go up daily, and since it's in your name you are responsible for the charges. If it's wrecked to the point it's not worth getting back, contact the tow company and offer them the title, they may work with you.

If you reported the vehicle stolen, at least you won't be responsible for any damages she did to someones property, so yes, to protect yourself do report the vehicle stolen.

When you do, she may or may not go to jail, but at least you won't have to pay for the damage she did crashing into someone.

If she is soon to be your ex-wife, sounds like you already have an attorney, so discuss options with him.

If this is in the UK, you should contact the Crown Prosecution Service and ask the prosecution lawyer whether they can request a compensation order when she appears in court for sentencing. You may have to provide a bill or proof from the car pound confirming the amount you have to pay. The Court may then make a Compensation Order for the estimated amount, which she will then have to pay.

Failing this, you may be able to make a claim yourself, through the small claims court. The Citizens Advice Bureau can advise you on this.

Your wife could go to prison for this offence but may be sentenced to a community order of probation or community service work instead. This will depend on the circumstances of the offence, her previous convictions and risk.

yer screwed...anything you own also belongs to wife....yes the court looks badly on people with multiple violations...my brother in laws wife took their credit card and ran up 30.000 dollars before divorce...hes still paying

You need an attorney, to protect you during this difficult period, and check on the possibility of a civil suit against your almost ex.
Also check with the local city or district attorney to see if criminal charges for taking the vehicle are possible in your state.

As far as her "stealing" the car, probably won't go as a theft due to you and her stil being married and said property would be considered jointly owned. However, if she had no license and took the car without it having tags or registration, she would be in trouble. No question about that. As far as the details, only an attourney could answer that for you. Maybe even ask your divorce attourney.

More than likely you will be the one to pay since you were still married and living together at the time. If you have kids, you will be paying child support like me for 18 years. If you don't , then you better find another wife and count yourself lucky.

You can try to file a stolen vehicle report, but if you're in Las Vegas chances are Metro will tell you no because you are married. However if they do take the report be sure to let them know you want to press charges.
