If he's here illegally, the only way to get him a legal visa and green card is for him to go home and then start the process from there. If he is not legally present (whether he entered without inspection or overstayed a visa), there is no way to get him any spousal visa or any other sort of visa. He has no choice whatsoever but to return to his home country. After he has completed the period for which he is barred from re-entry, you can apply for a spousal visa for him. The problem will be getting it approved if you do not live together. Your only solution is for him to return home voluntarily and then for him to apply for your immigration to his country. After completing his bar, you might try to get him a spousal visa. If you make any attempt to change his status while he is in the US illegally, you expose his illegal status and get him deported. He'll be barred from re-entry longer than if he returns home immediately and voluntarily. If he is here on some kind of temporary visa, such as student or work visa, he must return home while you apply for his spousal visa. Marriage cannot change the status of a non-immigrant visaholder. After he returns to his country, you can apply for the spousal visa. It will take about 2 to 2-1/2 years to be approved. Spousal visa requires that you prove a valid marriage (when and where you met, how long and how well you know each other, etc.) and prove you have sufficient income and assets to support your spouse and guarantee a $30,000 bond.
