Do I qualify for US citizenship?
|
I'm confused as to whether I am qualified to apply for US citizenship.
I've been and still am in China (will be back in US 01/2011) since 04/2010, which is 10 months.
I traveled outside the US for 91 days in 09, 22 days in 06, 20 days in 04.
I became a permanent resident in 1997 and have resided in CA since.
Based on the information above, do I qualify for US citizenship? (I'm worried due to the continuous residence clause)
Do I need to get back to the US asap?
Do I need to stay in the US for 3 months or more before sending in my application? Additional Details I was getting ready to head back to the US in July this year, but my grandmother had a sudden heart attack and almost died. I have proof from the hospital and my phones/apartment/bills are all still active in the US. Would this be enough to prevent my green card from being confiscated since I'll be here for 10 months?

just come over here illegally.......because if u havent heard, we are getting ready to do a big "immigration reform" meaning our wonderful government is gonna make all the illegals legal....and reward there illegal crossing, so just jump on the band-wagon, come here illegally, pop out an anchor baby, and then stick out your hand and you shall be rewarded.....

you need to take the citizenship test as well (my mom had to) and you also have to live in the states for at least 10 years (i believe)

In 2010, you are already absent more than 6 months, which means your 5 year continuous residency will start this year. Any year you are absent more than 6 months turns the clock back to zero for 5 year continuous residency.

After 6 months absence, the residency clock stops. What that means is that you "lose" 4 months of continuing residence if you return in January. No big deal. The previous absences are less than 6 months each, thus they have no influence at all. Since you are a LPR for 13 years now, you are indeed eligible for naturalization.
There is one caveat, however: once you have been absent for over 6 months, the CBP officer at the POE may, or may not, question you in regard to your residence. Even when abroad, you need to maintain your US residence. He or she may, or may not, ask for proof, in form of your apartment lease, car registration or insurance, etc. Just be prepared to have a plausible answer if asked about it.
Other than that: green light all the way.

It doesn't really matter what proof you have,if you don't meet the statutory requirements you can't apply and thus must await 5 more years.Piano,is actually right on the money considering the clock resets and is based solely on the last 5 years of permanent residency for Naturalization purposes.
