i have searched the home office website with a fine tooth comb i can not find any info on applying for a passport or when to apply i have also looked on the UK passport website again can not find info i am looking for

A Visa, be it temporary visitor or permanent residence, is not naturalisation or citizenship so would not be grounds to be issued a passport.

You best chance of getting a correct and definitive answer to this question is to contact the Identity and Passport Service ( http://www.ips.gov.uk/ ) and the UK Border Agency ( http://www.ukba.homeoffice.gov.uk/ ).

The Dark Side
Only British citizens can have a passport. As with any country, it only issues passports to its citizens - for one thing, a passport is proof of citizenship. That is why you have found nothing. You need to become a British citizen FIRST. Until you have lived in the UK for over 3 years and been naturalised as a British citizen, you cannot apply for a British passport.

You won't find details of how to apply for a passport on the UKBA website as it's a different department that deals with passport applications.

Before you can get a British passport, you must become a British citizen.

If you have a spouse visa, you must live in the UK for two years and still be married and living with your UK spouse before you can apply for Indefinite Leave to Remain. After three years legal residence in the UK you may be eligible to apply for citizenship. You must have ILR before you can become a British citizen.
