Adoption questions, what to do...?

So I have a strange sitation and I am a little confused on what to do. Here is the situation... Well we have had legal and physical custody of my step-son for approximately 2 years. The mother is living in a different state because she went there and got into trouble and is forced to stay there. She was only willing to visit her son when she could make time, or find a ride in order to see him. Well, to make a super duper long story short... She has not seen him in over a year, she has called a couple of times within the last year and she does not pay child support at all. Is there grounds for terminating her parental rights and/or adoption?? We currently reside in Wyoming. Thanks! Additional Details Well actually my step-son was placed in foster care away from his mother when he was 6 months old for being abused and neglected. We didn't find out about the child until he was 3 years old. His mother tested 5 different guys to potentially be the father. Me and my husband have been together for an accumulation of 12 years, and he was born from a one night stand... So I have known and had custody of the child since we found out that my husband fathered him. She is actually in a different state now and has been convicted of neglecting her other child.. She doesn't deserve the right to be in his life. She hasn't been there for his entire life, except for the time she spent with him for 6 months, where she was using drugs and alcohol.

Yes, you could try to prove abandonment since she hasn't seen the child in more than 6 months - have you talked to her about maybe relinquishing her rights and is it really necessary to change the child's birth certificate over all of this - a lot to think about.

go down to the court house and file for full custody.. they will send her papers.. if she does not sent them back or even answer the court will go on as if she was dead.. because she did not reaply.. you will get your son.

ummm... in some states..idk about wyoming..
but if a parent hasn't seen a child or payed child support in two years than you can terminate rights & you would be able to adopt the child.
or you would have to talk her tinto signing over her rights..
you have to wait another year honeyyy.

Is it not enough for you, that your husband has legal custody of his son? You are this child's step-mom, married to the boy's father....why do you want the boy's mother totally out of the picture, as in erasing her name from the boy's birth certificate? The boy lives with you, your husband has legal custody..am not understanding YOUR need to adopt your step-son. I am sure this little boy calls you 'Mom' and sees you as a mother-figure. Do you need to have a piece of paper to tell you this? Evidently you married a man who was either married to another woman who he had a child with or knew he had a previous relationship with another woman, wherein a child was conceived and born. But you married him knowing this....do you think adoption of your step-son will make this boy completely yours...as if no prior relationships occurred between your husband and another woman? Sorry to sound so offensive...but thru out my adult life....I have heard more times than I care to remember.. the new wife complaining about the old wife and trying everything in her power to further distance the new husband from the old wife and yes..to further distance the step-children from the mother they no longer live with. Your step-son is not being abused by his mother...he lives with you and his father who has legal custody of his son. I think there is more here, than what meets the eye.

Yes there are grounds for terminating her legal rights and you need to pursue those rights now. If you don't have legal custody go to court and ask for legal custody and from there work toward permanency.As a court observer I have witnessed this being done many times. And in one case the man had no attorney. In your case the state's attorney would be representing you I believe. Go for it.
