Are you allowed to break the speed limit whilst overtaking?
|
For example, if I was driving along an A road with a 50mph speed limit. There is a car in front doing 40mph and I signal and begin to overtake and they put their foot down and increase to 50mph. Assuming I'm neck and neck with them I have to break the limit to get passed them. What is the correct course of action. This question assumes that there is no oncoming traffic, ie I'm overtaking safely.

NO! There is never an excuse for speeding. The proper course of action is to fall back and pull in behind the offending lummox.

Technically, it is NOT legal to exceed the posted speed limit.

No, speeding is an "absolute offence" and there are no time you can legally exceed the limits.
In this instance your "proper" course of action would be to drop back behind them.
However if you did speed upto overtake and there was a police car around and saw it they would probably pull the other car and do them for inconsiderate or careless (possibly dangerous) driving.
If there was a camera then you would get done as they are just cash cows and take no notice of the circumstances at the time.

Your best bet is to slow down and get back behind him, but if he does it again, then pass him at a higher speed!

Legally not but I was observed by a serving policeman and tested by a serving policeman when taking my IAM test a few years ago (on a bike) and both encouraged sharp acceleration on overtaking even if it meant exceeding the speed limit - I still do it as a matter of course.
Minimising the time you are on the wrong side of the road is always a good thing in my humble opinion

If someone ever does that do not keep trying to pass them. These situations can and do escalate and before one knows it they are in a collision. Just back off and call the Police. They are the ones that should be handling this @sshole.

No, there are no circumstances in which breaking the limit is acceptable, You're supposed to drop back.
As the IAM and police driving courses say, if you have to exceed the limit to overtake, then the overtake isn't necessary.

legally, no, there is no provision to permit speeding. you would slow down and re-enter traffic behind them when safe to do so. they would also be in the wrong for speeding up or refusing to allow someone to lawfully pass.
realistically, floor it until you can safely get in front of em.

The alleged correct & legal course of action is to drop back in behind the car.
Personally, I'd be very inclined to just put my foot down & gesture obscenely!
