Work issue! Help!?
My dept at work is treated unfairly and not getting the madatory breaks we are supposed to get. After being yelled at for going to the bathroom, I called in a complaint to the headquarters. My co-workers think I will get fired for complaining. I don't see how that is possible since the company is the one doing wrong. What do you think?

You may have to defend you words, and be ready to show proof of what they are doing (just document it every time they yell at you). But if they do find out it is you, and you live in an at will state, then they could find any reason to fire you. Your job sounds horrible, you should start looking for a new one no matter what happens

You can't be fired for complaining about something that is required by law. ie. mandatory breaks. If management terminates you because you complained then you need to talk to a union steward if you are in a union job. If not, then contact Osha. By law, your employer is required to provide adequate breaks depending upon the amount of hours you work daily. If the employer is not complying, they face hefty fines. Of course, there are two sides to every story. I have an employee who seems to think she can go to the bathroom 5 minutes before every break time, thus extending her break to 20 minutes instead of 15. After 2 verbal warnings, she has now been written up formally and if her behavior does not change, she will be terminated. I've told her unless she has a medical condition (and a note from her doctor) that makes it impossible for her to wait an additional 5 minutes, she is no longer allowed to use the bathroom until her break time. Interestingly enough, I've never gotten a note from the doctor.

Perhaps the bathroom usage was getting out of hand, and unfortunately, the employer doesn't have much of a choice but to put a stop to frequent bathroom breaks.
