Verbal resignation???
i had an argument with my companie the other day and told them i resign, i have not put this in writing!!

i had my normal days off then got a phone call last night telling me not to come into work as my resignation had been accepted and was told to speak to the HR ddepartment today

my question is, Can they accept my resignation even though i have not put it in writing??

Yes, they sure can.

Don't try to collect unemployment b/c they don't have your letter, b/c I guarantee there will be witnesses to what you said.

The HR dept is just going to send you information probably on COBRA, etc.

Next time, keep your temper under control if you want to keep your job.

They can accept it, however you can still withdraw it on the grounds it was a 'heat of the moment' action.

You need to clear the air before you return though as the arguement may still lead to a disciplinary action against you.

If you're working at Taco Hut or Banfield Pet Hospital, you can just say "I quit" and walk, since those are dead-end jobs staffed by inept, nit-wit losers. If your job is professional and you have any integrity, you owe them what you likely agreed to when hired-- a written resignation and probably two weeks' notice (usually waived under reasonable circumstances).

Yes they can as it is just as legal as a written one. Just goes to show that bluffing the grand gesture is a risky route to go down. Try apologising and be humble then they might allow you back. They could be awkward and offer you a new contract at a lower salary or even a lower level of employment.

IF you told the right person (the one next up from you in the hiearchy) then yes, they CAN rely on your verbal statement.

HOWEVER, IF you go back in and renounce your statement, that could put a different spin on the matter. If the issue goes by for three working days and no status change is made (you said you quit and did not come back in for three working days) you could be said to have abandoned your job.

Go back in and just say you misspoke and that you have had time to reconsider and you are recinding your verbal statement. THEN watch the fireworks begin.

First off accept you have no job now... doesn't matter if you resigned or not they don't want you back so that is a moot point.... In fact it doesn't even matter if you resigned or not you wont get any unemployment because of what happened... if you had resigned then you would not be able to collect it.. And as your question implies you left in the heat of an argument which if you did so prior to the time you were suppose to be getting off work would imply that you just left work which would give them cause to terminate you (no unemployment for that either)...

So in the future you should control your temper it just cost you any unemployment pay.

Technically yes. A verbal contract contract (in this case the contract is yours to resign) is as legally binding as a written one. However, the problem is proof. If you don't actually want to leave your job it would be up to your manager to prove that you said you wanted to quit. He/she would need find someone who overheard you and who would be prepared to testify that you did indeed say you wanted to resign.

Check your original contract also. Most companies require you to give a period of notice before you leave in which time you can withdraw your resignation. Your best bet would be to go in and speak to HR and explain the situation. It would be more beneficial to the company to keep you rather than spend time and money recruiting and training someone new! Good luck!

If you had this 'verbal spat' in KENTUCKY...it wouldn't matter what you said, since it is an 'at will state' meaning that the employer can fire you for any reason that they want to provided it is not due to some protected reason (your religion, your sexual preference, your race etc)
You can meaculpa all day long and loose your dignity as well as your job

I have been in HR for 16 years this year. Nice ploy that they used. I am assuming that you resigned due to something going on at work? Well, before it gets out of hand lets accept this resignation immediately and have her contact HR before we face a lawsuit. Although it may not be won, they never want that. In short, the answer to your question is yes. They can accept your verbal resignation. It doesn't have to be in writing. Writing is a courtesy to hopefully ensure you receive a good recommendation for a future employer. If you do not wish to leave your place of employment and it is due to an abuse of a manager or co-worker I would certainly advise HR of this as the cause as to the reason why you suddenly resigned. If they are smart (and most HR people are not) they will try to convince you to stay and they will take care of the matter. The best of luck to you. Girl been there done that.

They can, I'm afraid. Sounds like they're glad to get rid of you, as they haven't tried to get you to withdraw your resignation, so saying that you spoke in haste isn't going to do you any good. You resigned, they accepted.

The short answer is, yes they can accept your resignation, whether you put it in writing or not.

If you'd now like to keep your job, I suggest you call your manager and apologise for the argument (even if it wasn't really your fault), and explain that you were upset and angry at the time and spoke in the heat of the moment. Say that now that you've had a chance to calm down and to think about it, you very much regret saying that and you actually don't want to quit at all. If you say all of this in a calm, apologetic manner, it's likely that they may well accept your retraction of your notice. But they don't have to. (Also call HR as you have been told to do.)

Now, if you've been asked to stay home instead of working your notice period, note that they do still have to pay you for this time. (This only applies if you've already completed your probation period.) You will receive base salary only, and not any bonuses or commission that you may otherwise have been entitled to.
