Record of Employment Concern????
|
I gave a two weeks notice to my current employer of quitting my job and today the VP dismissed me saying that I wasn't productive, and I would still technically have 2 more days to work, but in this case what will it say on my Record of Employment? Will it say Quit or Dismissed??
Is what the company did illegal to fire someone within the two weeks notice period? After I have already submitted that I will no longer work there.

The Record of Employment is a private document that need never be shared with anyone other than government agencies.
No one can say for sure what it will say. However you gave notice and I would expect that it will have the code letter E signifying the reason for leaving was you Quit.
Now if the company issues it with a code letter M for Dismissal you very well might have a legal recourse if they do not pay you for the full two week notice period. In fact they could also owe you severance based on the number of years you were employed.
I would wait to get the slip. If you are not happy because it says you were dismissed then seek legal advice. Being dismissed would potentially allow you to claim unemployment insurance whereas quitting would not.
It is not illegal to let someone go with or without cause anytime during heir employment (with perhaps an exception for someone on medical leave such as pregnancy). It is a legal requirement however to compensate the employee through severance pay and the amount of the severance is based on a variety of factors such as years of employment, age, expected time to find a similar job, was it for cause or other reason, etc. Your recourse if you are fired without compensation is to sue for severance.

Do you have another job lined up? If not, since they fired you, you might be able to collect unemployment benefits.

You gave notice first so you can say that you quit. People often are asked to leave early after they have given notice. Don't let it bother you.

Your record of employment will most likely say that you were terminated. Although it will not be seen by a future employer, the information on it will be used to determine your eligibility for employment insurance, and a potential employer may call your company and learn about your termination.
It would be worth discussing with the labour board. If you were really doing that bad a job, you should have been informed long before you had already resigned. It sounds like your employer is trying to get away without paying you a severance. Your ministry of labour is there to answer questions and deal with situations just like this. It won't cost you anything to discuss this with them.
Good luck
