Only where he is presently working can answer that. If they agree, under the circumstances, Why Not? Ask...is the only way..or Call the labor board...Elisayn

Pick me for best answer!!
You husband does not have to give notice. They fired him. I doubt they will take it up in court or whatever that he left a little early.

Notice isn't a legal issue. It's normally the right thing to do, but under the circumstances I wouldn't feel obligated, and the first employer should certainly understand that.

In the UK 1 week's notice is a legal requirement, however it may be more depending on the terms of employment.
Be aware that some companies write into their terms that if an employee leaves without giving the required notice they may with-hold some pay (amount will be specified, ie. 1 week's).

Just to keep things clear and leave with his a clean slate with this company I would send them an e-mail or letter letting them know he has received the letter and has found other employment, thank you. Something like that. Just to notify them that if they change their mind or come back and say they want to keep him he has already accepted something else.

It depends on the state you are in. Most states these days are "right to work" states, which means an employment contract can be voided by either party with or without notice for any reason. Unless there is a specific clause in his contract that states otherwise, he is probably free to go whenever he wants.

Note: Anyone saying that notice is not a legal issue better be very careful if you leave a job. A company has every right to put it into an employment contract. If you sign such a contract you are bound to it.

To not burn bridges, have your husband write a short note stating his resignation due to the notice given by his company. Thank the company for his employment there and advise them of his last day. That way there will be no bitter feelings on either end. It's the company's loss. .

They gave him 2 weeks notice, all he has to do when he leaves on Friday is to tell them he won't be back to work and turn in any keysid cards and whatever else he may have been issued. I wouldn't do it before then as they could panic and think that he may become a 'disgruntled employee' and do something to they computers or files or something else. If they dismissed him before Monday you will be missing a couple days worth of pay.

Good luck to him on the new job.

since he's already secured another position, he should tell them "today will be my last day' and be done with it.

Notice isn't required by any law. It is merely a professional courtesy. I think in this case he should tell them he is leaving. If they were planning to let him go anyway, it should not be an issue. The only concern may be that he may lose out on any severence that he would get, but the security of having a job is more important with the economy being shaky.
