Legal actions for new prospective job contacting my employer w/o my permission?
|
ok well my situation is a bit more awkward and I want to hopefully get some good answers here.
I live in the state of California.
I applied for a job recently and had a phone interview which went well and my information was forwarded to a on-site manager for a face to face interview this week.
The problem is I didnt' want my current manager to know I am looking to leave my job for another (like most wouldn't) but it turns out her friend works in HR for this other company, and her friend called her and said "did you know your employee applied". She confronted me about it the other day and it made everything awkward and now I feel like I have to watch my back so I don't get thrown under the bus for any ol' reason.
I contacted the lady I phone interviewed with to tell her that "someone" contacted my current employer and it has jeapordized my current job and being so early in the interview process I didn't understand why they would do that. I told her I didn't remember authorizing them to do that and she said " no you didn't, i'll look into this. and i'm very sorry this has happened" I kept my knowledge of how much I knew to a min. b/c I didn't want to sound threatening or vindictive. But then a few hours later my boss was calling me on my days off (which she never has before). I asked my co-workers if they knew why and they said no.
I'm thinking the girl in HR (her friend) got in trouble and told my boss and she was calling to say something to me. But she is not here so I don't know anything yet. If that's the case I will most def. report again that someone was communicating and breaching my confidentiality.
My question I suppose is, if i do NOT get this position, what legal actions can I take being that not only did I not authorize the contact, but the fact that it was a "friend speaking to friend" situation and who KNOWS at all what they talked about.
someone please help me on this!!! i'm freaked out and LIVID and upset!

Good luck proving that if you do NOT get this position that it had anything to do with that situation.
I think you might have a case against the interviewing company if you were to lose your current job as a result of your boss knowing that you were applying for another position. But it seems unlikely that it would be in the interest of a company to fire you for this reason. Perhaps they would reconsider promoting you, but even then I don't really see it.
It's likely that they'll reprimand this person for violating your privacy; it is certainly a fire-able offense if they wish to take it that far. No one can put the toothpaste back in the tube though.
However a boss knowing that you are considering working elsewhere is not always a bad thing for you if you are a valuable employee. It can give you a better bargaining position.
Don't go telling everyone at work how violated you feel and how angry you are. Avoid drama at work. Handle the situation correctly. If your boss was looking for a reason to "get" you, he/she would have found something sooner or later anyway. I understand why you are upset, but don't decide that you are a victim and go howling and rolling around on the floor. If you are a valuable employee you should have nothing to worry about. And in today's economy, be grateful that you have a steady job.
An apology is all you're likely to get from the company that you interviewed with. Accept it graciously and move on.

All you will accomplish is getting that person fired. You have no recourse since the company never officially contacted your current employee.

it is unfortunate but , there really is little to be done,I don't believe any legal breach was made and would be hard to prove any malice in court
