There are lots of laws both State and Federal, there are also lots of Penitentiary's too. I guess not all laws are willfully followed.

No, there isn't. The law says that if you meet certain requirements you have to be paid time-and-a-half for overtime (over 40 hrs. in any one week), and that for every so many hours worked you have to get a break of a specified number of minutes, but the work schedule is left to the employer. Yeah, sometimes it sucks, but a lot of people are out of work who would love to have that 7-day / week job, so they can keep their house, etc. When the economy gets tight, it's an employer's game. The tide always turns, sooner or later, and now that you know how your employer might treat you, get your resume ready and start looking when the economy kicks back into gear, and your work week goes back to normal.

Oh, wouldn't that be nice? No, as long as you are being paid correctly, they can work you until you drop. If you are paid by the hour, you must be paid OT per state and Federal law (more on this at www.dol.gov.)

If you are in a salaried exempt role, you are technically "on the clock" 24/7 and can be expected to work accordingly.

You have to be paid overtime but there is no limit on what you can work unless there is a union dictating what can happen. My husband works 60 hours a week. It is not illegal just exhausting.

Also, if they are paying you overtime pay for the hours worked over 40 hours a week, it's generally legal.

Of course, you do have the right to seek other employment if this job isn't right for you.

as long as you are over 18 federal law does not regulate how many hours and does not mandate any breaks unless the job is one of those where hours can constitute a health or safety risk (example: mining operations). those jobs are designated by the secretary of labor.

With the job market the way it is right now you would probably get fired if you raised dissent. But then you could get unemployment if you've worked there long enough. In California where I live you have to work and make $1200 before you can get unemployment.

I'm pretty sure that they have to pay you OVERTIME for anything over 40 hours and I believe that's federal but don't quote me. But if you remind them about the overtime they might cut your hours back or they might cut them off. If you're a "valuable team member" then go for it, especially if you are making the company at least $50-100 an hour and you're getting $10 or so per hour.

The person to ask all these questions would be the Labor Commissioner for your town. If they are abusing you he will be able to file the necessary papers to have them pay you what they SHOULD be paying, but with Jeb as governor and jobs as tough to get as they are right now you may not get far but the Labor Commissioner will have all the answers and all the power you need.
