Is starbucks liable?
I went through the Starbucks drive through and got 2 drinks to take home for me and my mom. When I got home I saw that one of the lids wasn't on all the way and had spilled all in the center console. The center console in my car has 2 cup holders and a different space for keys and stuff like that. I had my cell phone in this space. As a result the drink spilled all over my phone and now doesn't work. I call starbucks and they said all they can do is apologize and give me a new drink. They also said that the lid was on and that it must have come off when I was drinking the coffee. The thing is, I didn't even drink it; both drinks still had the paper wrapper on the straws. Is Starbucks responsible because they didn't put the lid on correctly? Is there anything I can do?

Go into the starbucks and ask for the name and number of their District Manager. If they ask why restate what happened. They have to give you the DM's number at corporate. Tell the DM you already spoke to the chain where it happened and were offered only a drink. DM's do not want unhappy customers. I guarantee you will get something, and more than a drink.

Nope. You always need to check things like that before you leave the drive in window...so forget the lawsuit, you'll lose and have to pay court expenses as well. Suck it up and buy another phone.

I think they are definitely liable...but because it's obviously difficult to proove I doubt you could ever hold them liable. It sure doesn't seem fair, does it? From now on make sure the lids on your drinks are on tight before you drive away.

This has happend to me too people are only human and make mistakes i brought on e home and spilled strawberry and cream all over my computer it was a mess but no there only thing they can do is replace the drink so take the drink so you get a free one next time and make sure they put the lid on the cup next time sorry this happends but ..... you have to live with it sorry

No, they are not liable for your damaged cell phone. It was nice of them to offer you a new drink. Once they pass the drink to you it's up to you to make sure everything is ok.

That could be a difficult one to prove in a case should it go to court.

I go to Starbucks almost daily, and there's been a few times that they forgot to put the lid on tightly - on the other hand, there's been a few times where I was securing it into the cup holder and didn't realize I had bumped the lid up, either by pushing too hard, or squeezing the cup.

You really don't know if you did it or if they did it since you didn't catch it before you left the Starbucks. Unless it had been in one of the trays and you never touched the cup itself, I'd say it's a very hard case to figure out the answer to.

No. First of all, it can't be proven that they did not secure the lid and secondly they are not responsible for the safe keeping of your personal property. Keeping your property safe is your own resposibility and you should have checked the lids yourself or not put the drinks near your cell phone.

I check lids on cups, and inside bags to make sure everything I ordered is in there, in any drive through.
You should do to the same
.. the lid can come loose when you grab the cup( I have done that myself, the lid loosens when I squeezed the cup to put it in the holder). It most likely would have been on put on correctly when they handed it to you that is their part of their job.

No. You are responsible for checking to see that everything is secure. How can you prove that you didn't hit a bump and jar the lid loose, something that would not be Starbucks' fault?
