Is it legal to deduct time off an employees paycheck??
|
I work in Washington State and my employer has a mandatory lunch rule where if you work an 8 hour shift you have to take at least a 30 minute unpaid lunch. Well I didn't take a lunch for two weeks straight and now they have deducted 30 minutes from each day off my pay. Is that right?

They do this where I work. Basically, you should take your your lunch no matter what is going on or how busy you are. I know it's hard to do that sometimes, but they can't say anything about it.

That is right. They have the rule, so they can deduct it.
However, they may NOT deduct for OTHER scheduled time that was worked. Let's say you worked 8 hours paid, and had 1 hour lunch unpaid, and they only paid you for 7 hours work. That would be illegal.

This is done so- automatically. it will be deducted weather you take lunch or not. inorder to get your full 8 hours a day you must have 8 and a half hours on your time card everyday to get your forty hours a week... My company does the same thing and no-one likes it at all... it just goes to show you how cheap employers are getting.. I mean its bad enough that the Gov't nickle and dimes you with taxes. Now employers are doing it too. Our world is becoming a much more sadder place to live in, with such pettyness...

No, it isn't - visit ww.dol.gov for wage and hour laws that are applicable - they should have the link to your state site. Your employer is in violation of the meal and rest period rules and owes you back pay for the time deducted.

Yes it is. If the employer says you get an unpaid lunch of .5 hours, they'll deduct .5 hours per day from the daily total hours worked, ie (End time - Start time) - .5 hrs
Also, typically, the employer has to authorize any overtime. Since you stated that you worked each day at least 8 hours, that .5 hr each day that you didn't take lunch would be considered overtime, which you didn't get permission for.
