Is it legal for employers to not pay on scheduled payday. Say there is no money and they will pay Monday.?

My sister works for a company that told her at 2:30 today that they wouldn't be getting paid. Only hourly workers would be getting paid today and that the salaried people would get paid on Monday if the money came in but that managers would be the last ones to be paid so she might not get paid on Monday either. This is not the first time they have done this either. They are located in Texas. I just want to know if this is legal or not and can she report them to anyone for doing this.

It is against the law... Call a lawyer, and be prepared for that company to be filing bankruptcy soon.
(In most states it is illegal, I should say)

You can contact the Labor Department or Wage and Hour in the state of Texas. They will be able to tell you if this is legal. However, this is a bad sign. She needs to find a new job immediately.

Taken from the Texas Workforce Commission Payday Law:
"Regarding timing of wage payments, the TPL requires employers to pay non-exempt employees at least twice per month on regularly scheduled paydays, and exempt employees at least once per month (section 61.011). "Exempt" has to do with whether the employee meets the requirements for an overtime exemption as a salaried executive, administrative, or professional employee under the FLSA. Pay periods do not have to, nor do they usually, coincide exactly with the FLSA workweek used for keeping track of hours worked for overtime calculation purposes. The paydays must be posted at the employer's office and at any outlying offices where employees normally gather."
"Paydays may be changed, but it would be best to give employees advance written notice thereof setting out the next three paydays - 1) the last old payday; 2) the first new payday; and 3) the next following new payday. That way, employees will not be able to credibly claim confusion, and the requirement of paying at least twice each month will be met."
as stated here the payday may be changed but it is suggested they do so in writing and in advance but by law they don't have to. if your sister is a member of management and is considered exempt then she must be paid at least once a month. if what they are doing is legal is questionable but ethically it is wrong......................................
with that said if there is no money to cover the payroll until Monday then there is no money. obviously this company is struggling and this problem may get worse before it gets better. your sister needs to contact the Texas Workforce Commission and see about filing a wage claim if not paid on Monday they will be able to provide more information.
