Is it legal for a company that you work for to force you to go to direct deposit with your paycheck?

No. They cannot dictate how you get paid.

I started my current day job about eight months ago, and upon hiring me they informed me that they had a policy of paying via direct-deposit only. Bear in mind, this is a small library with about 24 employees, so it's more laziness than anything else, frankly. Anyway, since I don't like direct deposit, I lied and told them I had no savings or checking accounts. They then said I would need to open one, and I told them I didn't trust banks. They finally relented, so I get a check cut every two weeks.

Yes, it's perfectly legal.

If you can't get a bank account, then obviously you either have outstanding bad checks somewhere, or have credit that is seriously damaged.

Not only is this unquestionably legal, it is also overwhelmingly practical. The advantages, for everyone involved, are so numerous this can hardly be described as laziness. For almost two decades federal law has prohibited government agencies from paying by check.

I hope this is a point of information and not a point of contention. The disadvantages of questioning this far outweigh the marginal advantage you would maintain. Perhaps it would be better to wait for an issue to align yourself with the company instead of against it. Good Luck.

Yes, its legal.

The direct deposit of your net pay to your
savings or checking account facilitates payroll
servicing. It also avoids long lines for check
encashments.

Often the main reason for forcing direct deposit of payrolls onto employees is twofold: it's most cost-effective and there's a check and balance set in place to verify that the company has duly forwarded payroll funds to your bank account. It's to your advantage to accept the payroll at your bank, instead of worrying whether or not it was "in the mail" or possibly stolen along the way to your mail box.

Good luck!

Depends on company policy. They didn't do the old bait and switch did they? If so that is a grey area. But if they told you up front or in the handbook then you were in the know or at least should have been.

It must be, because the company I work for did it and has had no backlash as of yet. We have been doing this for about, I guess a year now.

You should contact your state labor board. It is quite possible that mandatory direct deposit is not legal, but it's also possible your boss/manager doesn't know this law. However, it is becoming increasingly common for employers to prefer direct deposit because it saves both time and costs.

If you are opposed to direct deposit just because you haven't had it before or because you like having a check, then I would encourage you to give it a try. The nice thing about having direct deposit is you don't have to actually pick up a check to get your money. Direct deposits are often available earlier than physical checks, and you still have access to your money on pay day even if you're out of town.

If you don't want direct deposit because you either don't have and don't want a bank account, or can't have a bank account, your employer should have some alternative method for paying you. I know my company had considered using something similar to a prepaid credit card where the balance was refilled with your pay check amount on pay day.

I am not sure if this is legal or not. I know some companies encourage direct deposit, and many banks have good deals on accounts with direct deposit. Why do you not want direct deposit? It will make it easier to save money for the future.

I think you can talk to your HR person about this if you really have a problem with it.

Good luck,
Dana (attorney)
