they can hold your paycheck for as long as they want. there are rules they have to go by.

i don't think it is legal. they would only get a small fine for that and you would lose the job if you rat on them to the labor dept. then you would soon be looking for another job, if you care. they are slapping "someone's" wrist to encourage conformity.

If you're sick your boss shouldn't be able to withhold your paycheck. I'd suggest filling out the paper unless it says something that claims you didn't act properly or some crazy thing.

In the UK it is very illegal. Its called an unlawful deduction from wages and the law does not like it at all

Negative! In fact, the employer is risking a hefty fine. He has only two recourses if you've not complied with work requirements. Either fire you or sue you. He cannot ever (legally) withhold your paycheck.

no way i would start looking for another job it could happen every week/month and land you with numerous bank charges for missed direct debits or standing orders which lets face it the boss ain't gonna pay !

In the UK this would be firmly against all aspects of employment law.

I doubt if it's legal in the US either.

Firstly, you should have a contract of employment which lays out your rights (and those of your employer) in the event of your being unfit for work; you may be subject to a time limit for sick leave or a number of occurrences.

In any event, breach of such protocols leaves you at the mercy of a disciplinary code which in the main does not render you subject to forfeit or withholding of pay.

Talk to a solicitor (Lawyer) at once - especially one who deals in employment law.
