It's down to the police and nothing to do with the employer until the suspect is charged and convicted. The employer may then choose to not employ a criminal.

its still a criminal case. common assault maybe affray with intention. i'm no lawyer but where works concerned the same law applies. we've all lost our tempers in work, i threw a shovel at this wankers head missed him and smacked a junior labourer on the shin when the shovel took an unforseen trajectory after it bounced on the ground. luckily for the person i was trying to assault with a deadly weapon and for the foreman they kept quiet (i was in no mood to be fuc'ked about). if you have issues keep it behind doors, mano et mano but if somebodys riding your back give them a jolly good biffing on the nose (in other words knock the cu'nt out of them) but in camera (out of sight out of mind for those unconcerned)

you're probably still under the same rules and regs. but, whether or not your company disciplines you (check the HR manual) the police can still be called by the victim.

The employee who hit the other could be charged with battery, but that's a legal issue, and would have nothing to do with their workplace.

Unless you have a contract, then you are an "at will" employee, which means that an employer can fire you for any reason, or even no reason, as long as he doesn't discriminate, (if you don't know if you have a contract or not, then you don't have one). If you are a contractor, check your contract to see if anything might cover this (if not, you are out of luck).
What happens depends on the employer. He can fire one, both, or neither employee, depending on how he feels.

Depends on the company, the situation, the people. Some companies have a by-law that states that is conflict occurs outside of the business that disciplinary actions up to and including termination can occur. If one person is still working, then they are both liable under the company terms (you are still on their property). More than likely, there will be some terminations.

its a case of bat;tery... even if both employees were still on the clock it would be battery... even if both were off the clock... or on company grounds... battery.
Now, will the employee that hit the other be disciplined by the employer? Well that depends completely on the policies of the company and the laws of the state where the people work. In a state that has employment at will, barring any union contracts, the company could fire either or both of the employees just because they wanted to.... in other states it might not have the option of doing that... or it could be even more difficult if the person hitting the other was in a union position.
Too many variable come into play on this one for a black and white answer.

You could be dismissed for bringing the company into disrepute. I've seen it happen before. It's gross misconduct and it can be done. That sounds like a very irresponsible thing to do!

One could be done for GBH irrespective of company procedures. Also, if one is taken to court then clearly, the company is within its rights to dismiss the employee concerned on grounds of gross misconduct, Violence and theft are grounds for dismissal without compensation. Also, if one is viewing porn on company premises then this too is a ground for dismissal.

If the employee who is working hits a previous employee OUT SIDE office hours, he is still liable for action for " Indulging in any act which brings disrepute to the organization". Police can also take action against him .
But if an ex employee hits an employee OUTSIDE his office, police has to take action !!
