I work at a fast food place, and want to know if this is legal?
I work a pizza place. One of the assistant managers posted up a sign today, and I don't rememeber what it said EXACTLY, but it said something along the lines of this: If it's busy, and you're supposed to get off at a certain time, they'll keep you there. And if it's dead (not much business), they can send you home. This doesn't seem fair to me because a. if we're scheduled from 5:00 to 9:00, shouldn't we get off AT 9:00? And b. if they send us home early because it's dead, we don't get our hours.

I'm wanting to know if this is legal? Like, are they ALLOWED to do that? Also, I live in Texas. I'm not sure if that's important, but it might be.

Any legal information? I personally think that it's wrong, because it's unfair.

if they pay u for it no if they dont pay u its illegal and legally ur only allwoed too work a certain amount of hours

In most cases, if you show up (and you were scheduled), and they send you home early, they have to pay you for 4 hours of work.

At my last job they didn't do that, if I were there for 15 minutes and they sent me home, I'd get $2.50.

They should pay you overtime if they ask you to stay later than what you were scheduled for.

Its very unfair. GO to your local labor department and ask them. I have been in that kind of unfair job. It may not be illegal, just wrong.... and no, they shouldnt keep you longer than the time that you have to go.

If you get fired, take unemployment and use it all you can.... go to school and get your unemployment check.... if you are in school, the unemployment will not force you to look for a new job...

I suggest other jobs for you where you are treated better... try working at a hotel or place with an union... hospital jobs usually pay very good and you are treated well for being a good employee........... let me know how if goes. if you need any more answers.. send me an email...

It is not fair, but it is also not illegal because it has been posted. Texas state law a business can hire and terminate employment at will. So if you do not obey the new rule or do not want to seek other employment. You could get all the employees together to let the manager know how you feel about the change, but I would not do it alone. It is easy to replace one person. I live in Texas also.

i did work at a pizza place also back when i was in h.s., i experience the same thing but i didnt mind it because i liked to go home early and my manager were my friends. but right now, i work in one of the greatest hotel/casino here in las vegas, our rule is when it gets slow and they need to send some workers home they would asked the full timers first "IF" they want to go home but if not they will send a part timer home no question ask. but we did have a rule for hours that we needed to work for. part timers needs to work atleast 24hrs/week and full timers needs to work atleast 36hrs/week its because the reason for being able to keep our insurance. so i advice that you research your companies rule because companies do have different rules you know? but if its like one of those minimum paying job, their rules are usually bs...or they just usually have stupid managers...

i actually had to complain about an Arby's that was supposed to close at 10pm, but began closing at 9:30 pm, then 9:15 pm ... i think just cuz they knew i liked to come make big orders at 9:45 pm

but legal? yes

They're probably looking for people who want to dedicate themselves to the Co. If you're just looking at the legalities of it all you probably won't last long. If you're happy there you don't mind working some overtime. Bosses read their employees this way. They're trying to save money by sending you home when business is slow which makes sense. It's like when it rains, on a construction job they'll send you home because of the conditions. Or when you're in show biz the show must go on whether you're up to it or not. Just quit if you don't like it.

I think the employer must pay you for atleast an hour of work. You should just look for a new job if you need consistently more hours.

I think this will depend mostly on your states labor laws. First off some states if you are scheduled to work and you come in they have to give you at least two hours. Some don't

Then the staying late, this isn't school I don't know of any jobs that have a set time to be off especially in restaurants unfortunately that's just how it works. When it's busy they need you when it's slow you are costing them money. Best advice I could give you is look into labor laws for your state. If you find something that doesn't make sense call your Director or operations or your human resources department and tell them what is happening.

...unless you have a "signed" contract concerning your wages, hours and working conditions... management can set the work schedule. (I know it doesn't sound FAIR... and it's not... but remember, the only thing that is FAIR is the Weather...and even that changes)

...in this economy, be thankful you have a job. (get a better education, get a better job !)

well i think when they hire you im sure its in the papers or if they have paperwork you sign not knowing it. i worked at mcdonalds and they always sent us home if it was dead and always kept us if it was busy. so i know completely how you feel. i didnt stay there very long! so yes i think it is legal/

It's not fair, especially when you're counting on those hours on your paycheck. But unfortunately, it's not illegal. Employers are not required to allow you to work, or pay you for, any specific number of hours unless you have a contract that states otherwise (as in a salaried job).

yes it is legal and a prudent business decision.
restaurants allowed labor cost are based on sales and management must constantly make adjustments.

it is legal in Texas and every other state to change your schedule with or without notice and Texas does not mandate a reporting time wage (minimum number of hours paid if scheduled).
