Ms. Betty |
I need Law/Legal advice in Texas please?
|
I bought a car the begining of last year. I signed the papers showing I purchased the car with "x" amount of miles on it.
I just did an auto check on my car (now a year and a 1/2 later...), and it shows that months before I purchased my car the mileage read at 50,000 MORE then what it was sold to me for.
I still owe on this car. It will be paid off by the end of this year. But I feel like I should be reimburst for being lied to....but I am pretty sure that wont happen.
Obviously the miles were rolled back, and I got screwed. Is there anything I can do about this on my own? Is it too late to take action? Or do I need to just get an attorney? Additional Details thank you TO THE ONES who had a bit of value to their answer. Yes this is a lesson well learned. And yes I should have checked b4 hand...but there is no going back. So thanks anyways

Thats why your supposed to check that stuff BEFORE you buy it.
I don't think a lemon law would come into effect for this.

First, file a compaint with http://www.RipOffReport.com
That will alert other people NOT to deal with these people.
Second, talk to a lawyer about your legal remedies.
Many lawyer's will do an initial consultation for a flat fee.
Good Luck

You don't need a lawyer. You need an affidavit from the person who last sold the car with the actual mileage. You can do the title search yourself, contact the seller, obtain the signature and file for up to $10,000.00 in small claims court.
I would suggest you file for the original selling price plus your repairs (They can't be reasonable wear and tear if the mileage is incorrect) in exchange for the car. Let the court address any adjustments for your mileage.
As they say, possession is nine-tenths of the law and your seller may not be to blame, but they are still responsible for this gross misrepresentation. Good Luck.

Rolling back the odometer on a vehicle is a federal offense. You should indeed be entitled to some sort of compensation. I would consult an attorney.

A good place to get a lawyer is with http://www.whatsyourwhy.net I used them for my car and they saved me $8,000 and the lawyers didn't charge me a thing to review the contracts. It works off a monthly charge and it is small. Very nice.
Worried about Identity Theift?
Been overcharged on a repair?
Purchased A home?
Traffic ticket?
Prepared a Will?
Been audited?
This is why I wont live/ leave home without it.

There really sin't anything you can do at this point since you have had the car and have been driving it there really is no way to pin point the exact miles it had on it before you bought it, you could go into a small claims court but I doubt anything will happen, sorry.

I believe criminal charges can be sought against the seller, as for compensation. You just might have learned a valuable lesson of conducting a search before purchasing a vehicle, not months after. That is how I would look at it. Wish you luck

Search for the person/people that sold you the car. If you find them, get an attorney. Chances are that the car was stolen. You will get reimbursed for the car, but the car will be taken back to the original owner. If it wasen't stolen, you will be reimbursed for the miles 1.5 for 1.

I don't know that the statute of limitations is here in Texas, but I would definitely contact a lawyer. There has to be something that can be done. You can also contact the BBB. I would let the place where you bought the car from know what you are going to do and see if they would want to settle.

That is messed up. A month ago my dad was nice enough to take my jet skii into a sea-doo dealer to get the oil changed and when he went back to pick up the skii they told my dad that they hooked the jet skii up to the computer and it had 2 coils grounded, over heated 2,000 + times, had a starter key missing, and some other things as well. I bought the jet skii new and my dad knew that it ran perfect when we stored it and that this had to be a scam. They thought my dad just bought it since it was under my name and they were trying to rip him off. I just put it in the water this weekend and it ran perfect. We are going to write a letter to sea-doo to let them know the dealership that we went to was trying to rip us off and you should try to get some kind of reimbursement for being ripped off or at least prevent the people that ripped you off from ripping other people off. Good Luck!
