Can an employer take a days wages off you for looking after your sick child?
A friend of mine is employed full PAYE. Last week her child was ill off school and she has no one else to look after the child. Her employer deducted a days wage from her because she could not get to work.

Is this legal?

yes they can, it's very low and immoral but it's legal. If you're not working then they don't have to pay you. This is unless of course you work for a union (if you are a teacher or something)

it is perfectly legal to deduct the days wage, and its perfectly legal (though not morally right) to tell the employer SHE was sick.

Check the contract and reconcile this with the relevant part of the Employment Act. You're a rubbish judge if you need to ask that.

If they simply did not pay her for a days work as she was off then no, they don't have to pay someone when they are off work, its irrelevant whether she was looking after a sick child or not, thats not their problem.
If she is on salary and gets paid montly and they deducted her pay by a day, it all depends what it says in her contract, I would imagine the employer can do what he wishes, because at the end of the day is your friend going to risk losing her job, go to a industrial tribunal, risk not even getting anything back just for the sake of a days pay ?
It seems mercenary I know, but companies just can't afford to go around paying people who are not at work, if they did everyone would be at it and companies would go bust.
Put yourself in their shoes, if you had a decorator coming to your house that charged a daily rate, he comes monday to friday (although misses wednesday), he finishes the job and you get a bill for 5 days work, what would you do ?

Unfortunately, an employer, unless the place of employment is in a state that mandates that employers must provide sick days to employees, is not obligated to pay for sick time. I work in New Hampshire and get docked pay any time I am out sick. My answer to that is that I come in sick and make everyone else sick. What can you do?

This would depend on whether this subject is covered in her contract. She is entitled to take the time off by law but not to receive sick pay for it. Some companys do not offer apy for you when you are off ill.

Yes of course it is, if she was sick and the company offers sick pay she would have been paid, however there are a lot of companies these days that do not pay sick days, so why should she be entitled to it if her child is ill?? I had 3 children and worked and when I had to take time off when they were sick fully understood that I would not get paid

totally legal, if ur not working u dont get paid, unless of course she asks fo a days holiday pay. btw if she worked 29/30 days she will get paid for 29 days he cant take a days work off unless she hasnt worked it.

yes its legal she has to book off time in advance to use holiday time or else its up to the bosses discretion, he said no, so NO. no work no pay. sorry.

yes they can but some companies will allow for this i belive up to 5 days a year you need to look at your contract, if you dont have a contract then really your employer can do almost anything they want.

yes it is legal. if she did not come to work she does not have to be paid. if she had any sick/personal time or vacation time available, she could have requested for them to use that as pay. but that is also at the company's discretion.

Yes, of course it is. She wasn't ill, her child was. It would have been more sensible to phone in sick herself. It would obviously have been dishonest though and if it happened too often, she would be in bother.

Of course it's legal. You only get paid for working. Or if you're sick and it says so in your contract.

What's illegal is not giving you the opportunity to looik after your sick child. They don't have to pay us as well.

Yes. If you're not at work then you have to take leave with pay. If you can't take leave leave with pay then it's leave without pay.
