Can an employee take sick leave out of your holidays?
A friend of mine has been told by her work that if she exceeds 5 days sick per year, then it will either be taken out of her holiday entitlement or she will have to take it as unpaid leave.

Is this legal in the UK?

My employer did. I was gong for medical test at the hospital last year, because it was an all day thing, a days holiday was deducted. He said I was only allowed a few hours to visit the hospital not all say.

Yes. Employers only have to pay people when they're at work. Apart from the legal minimum holiday.

It is illegal to ask for her to use holiday entitlement.

Visit the DTI website and ACAS websites to get advice.

In the UK you are entitled to SSP, sick pay and 20 days payed holiday each year at normal pay rates. This is going up to 25 days. Although these figures include the 8 UK bank holidays.

They are not allowed to take it out of her holiday time. However she is only entitled to be paid by her employer for a certian amount of time, this is decided by how long she has worked there. Once they stop paying her for sick leave she has to make a claim from the Government through the local job centre in order to get paid Statutory Sick Pay.

Sort of - Sick pay is paid at employers discretion so they don't have to pay it although they do have to pay SSP. Get your friend to go to the CAB for further more accurate advice.
