Can I still get unemployment if I asked to be fired and my employer agrees?
I was called into the manager's office and berated for poor job performance. They kept going on and on and finally I asked if they were 'letting me go". He said no but do you want me to let you go? I said yes simply because I felt like they were trying to get me to quit. This way I figured I'd get unemployment. They contested it (I guess most do) stating exactly what I just said, but no misconduct or anything. I live in Michigan and I think it has to be pretty serious to be fired and be turned down, and I don't think simply asking to be fired is really willful or wanton. Plus it's hearsay, it's not as if I was fired for a specific incident that I was warned about or was documented.

An employee cannot get unemployment benefits if they quit, without certain extenuating circumstances that depend on your state's laws. Employers do not ever want to have a former employee get unemployment benefits. Many employers make things hard for employees just so the employee will quit and then not be eligible for unemployment benefits. Unfortunately it looks like you walked into this one.

As an at will employee (no a union member) you can be terminated for anything except discrimination (see www.eeoc.gov). But this is not your case. You asked to be fired or legally you quit. No, no hearsay involved here. You quit.

You may want to contact a local attorney who has experience in the appeal hearing. Remember this hearing is your final opportunity to make your case. The hearing is run by an administrative law judge following the rules of evidence and your state court. The rules for receiving unemployment benefits are very specific, an attorney will be able to determine if you qualify considering that you quit.

You resigned, the employer asked you if you wanted to go and you said yes. You resigned and therefore cannot collect unemployment.

I live in Michigan. I never heard of anyone getting unemployment after being fired........perhaps I lead a shattered life........

The situation you described is usually referred to as "constructive discharge" and is usually eligible for unemployment. You did the right thing by being honest in your hearing. It's impossible to say without all the details, but typically unemployment benefits are granted in this scenario.
