Application form question?
There is the usual race monitoring form in there and it says if I do not fill that form in my application will not be accepted.

Do they have a legal stance on this or not? Can I be forced to fill this in or not?
It is for a local council job.

This is the first time I have ever heard of a Local Authority having to fill quotas with regard to ethnic minorities or the disabled, in my experience the best person for the job usually gets it.

The form should give you the option to say "Prefer not to say" or something similar. It is for monitoring purposes. You could also ring the place where you got the application form & ask them to clarify it for you & what use the information will be put to.

If they are an affirmative action organization they can ask you to fill it out. They have to keep statistics on the people they hire. So much for progress...

The local Council will be under obligation to employ x number of people from ethnic minority groups, disabled people, transgender gay and lesbian. Positive discrimination in this way is perfectly legal. If you don't fill in the box your application will fall by the way-side.

that is totally unfair but im not sure if its illegal-if not it should be-most forms now say "to be fair to everyone" well if it was fair you shouldnt have to tell them at all-

There is usually an option to tick for each selection which states either "Other" or "Decline to Answer". I'd fill it in and choose those options.

Not that this is what you're asking, but ... equal opportunities monitoring pisses me off no end. They achieve the opposite of what they set out to do. Any employer should be looking to hire the best person for the job, not to hire x number of females, x number of black people, x number of deaf people, etc. But with use of forms such as this, it ends up that anyone who ticks the "disabled" box, for example, is almost guaranteed an interview.

And before anyone calls me bigoted, please know that I am disabled myself. However, I'd prefer to know that I got a job based on my own merits and not because an employer had decided that they'd better hire a disabled person to fill their quota.

they don't do that to be unfair but to be fair to all people!

companies have to go through discrimination testing to ensure that they have an equal balance of people.
