Question on a room mate with a verbal contract for damages?

I had a friend who, slowly, began to live with me (spent the night one week, two nights a week later... until after 2 months he was living here). At first I asked him for food, after months of barely providing that (buying foods I'm allergic to...) I told him to pitch in $200. We had a major falling out and we talked, (with his boyfriend who moved in as well) and decided to split the bills in 3 ways and move out together. One day, they decide to move out, about 2 weeks after we were all putting in applications to other complexes. I asked him about the damages he did to all my stuff and he said he would pay for them! Now, he's refusing to sign the contracts I bring him saying he'd pay for this stuff (his BF is a sweetheart and signed the contracts for the damages he caused) and now I don't know what to do! He's gone and owes me about $700 in damages. Can I go to court over a verbal agreement with witnesses who heard it?

Unless you have his signature on paper with terms agreed to by the both of you, then you can't take him to court over anything.
You can't prove that he verbally agreed to the terms and he can always say you're lying.
Good lesson for next time, don't let anyone move in with you unless you know them better and their name is on the lease. And if they damage something, make them sign a paper that states they'll pay for the damages, if not, move out.

Yes, verbal contracts are enforceable, with witnesses you should be in good shape, take pictures of the damaged items, and try and get a list of all the factual details, such as the day, when, where you guys made the agreement, but the fact that it isn't in writing doesn't matter, that's just a bonus, but verbal contracts are enforceable for any aspect of contract law almost, except for certain things such as mortgages, etc.
