During school my art teacher repeatedly yelled at me for not saying the pledge and not standing up and "paying my respects" i told her it's my right to sit if i wish, she then kicked me out of class, which i refused because of the reason. I later got called down to the office and was harassed and questioned by my principal, she told me "i had to stand" i told her to try and make me. Then she said she would make me stay after school for 3 hours standing looking at the pledge. Isn't there some kind of law against this? And what i was doing was freedom of speech, i heard there was a law passed saying that students did not have to stand if they wished not to. I told her this, she said i don't care IM telling you, you HAVE to stand.
She then kept on asking me about my religion, and i told her i had no religion she said then there's nothing preventing you from doing it i said if i don't believe in god, id called that prevention
What do i say to her next time? And is there a law against this

There are civil penalties for not standing for the pledge of allegiance, I believe. If you're not standing as a freedom of speech claim, then be prepared to go to court.

Ok I'm not sure of your race but this goes 2 ways. If your not American and you immigrated from another country to there then you got no right to be in that country. Now if you are American, was born and raised there then you got every right to not do the pledge because your already pure American. To me it seems like there trying to make this into some sort of religious thing and if your not religious then you have every right to tell them where to go.

My answer to you is do what you want. Me myself am a 17 yr old "African-American" as the public puts it and I don't say the pledge of allegiance either. If a teacher ask me why I say because back in that time we were still trying to be accepted by society as blacks because it was originally made in 1923 but was edited in 1954. racism was still high in back then (although it is still going on today) I know about the pledge I just choose not to say it because of those struggles from long ago. YOU DON"T HAVE TO STAND.........BUT you should at least stand because it is a whole nations pride to say it so it is disrespectful not to stand and that is probably why he got so irritated by you not standing. You don't have to say it but I say at least stand.

There is a law against it, but I'm not sure what the number is. You could contact the American Civil Liberties Union (google, I'm sure they've got a website where you can contact them). Also try legal aid in your city. I applaud you for sticking up for your rights.

You cannot be forced to recite the pledge of allegiance, since it contains a reference to a religious concept. However, standing up is not a religious act, so it is not covered by the first amendment. The school does have the right to make you stand or sit whenever they want to.

I'm not sure what state you're in, so I can't say anything with certainty.
My advice to you would be to stand. She can make your life hell if you don't. She DOES have the right to give you detention, suspension and make your school record look as though you were a troublemaker.
Schools have attorney's to fight on their side, so it's not going to cost the school anything to defend their side in court, but it will cost you financially, and perhaps down the road if your student record is used in determining your eligibility to get into a university.
Is it worth all the trouble that you're causing? What is your exact issue with this? You've never stated that.
Do you not want the freedoms of our country? or you don't want to conform?
Figure out WHY you don't want to participate and then take your arguement from there.
My guess is that if you go to court, the school will prevail and you will be plagued with the "troublemaker" stamp, which will cause problems later on.
Choose your battles wisely.

First off, freedom of religion is considered by the United nations to be a fundamental human right
"Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship, and observance."
That's from the 1948 Universal human rights charter.
Even better, I assume you are american? Americans have a habit of assuming that everybody else is from their country on Y/A so i think you might be :)
Thomas Jefferson wrote in the Virginia Statute;
Virginia Statute for Religious Freedom was written in 1779 by Thomas Jefferson (A founding father... he wasn't a christian by the way, did you know that? Anyone claiming that America was founded on christian values rather than on french post-enlightenment libertarian values needs their heads checked). It proclaimed:
"[N]o man shall be compelled to frequent or support any religious worship, place, or ministry whatsoever, nor shall be enforced, restrained, molested, or burthened in his body or goods, nor shall otherwise suffer, on account of his religious opinions or belief; but that all men shall be free to profess, and by argument to maintain, their opinions in matters of religion, and that the same shall in no wise diminish, enlarge, or affect their civil capacities."
There you go, better than just laws, these are foundational teachings of both the civilised part of humanity and the American government.
You've got Thomas Jefferson on your side, go to them with that, your civil capacity was affected by you being kept after school, you were also compelled to stand, you were also, as per the UN charter, not allowed to manifest your belief by not observing the pledge, which is a pledge that purports monotheism.

It certianly sounds as if your teacher and principal are being rather unreasonable. This would be using your right to free speech, to peaceful protest, however in most cases public schools are not bound to follow these laws (for some reason unknown to me.)
Keep in mind that legally, your principal cannot make you do anything, as they have little more authority than a regular citizen. They don't have that authority, but be prepared for the consequences, such as more detention or suspensions.
My advice would to be just to stand for it. You don't have to say it if you don't want, but is it really worth the trouble?

I don't believe you can be made to stand. Not saying the Pledge is as much a freedom of expression as standing and making the pledge. I am not an attorney, but I don't believe the school has "legal" support for their position. Of course I am curious about what your parents say.
I would ask them to show you the law, as it is in the Constitution or Bill or Rights, that forces you to stand. You may choose to speak with a counselor. Or, just come in class after the Pledge is over. Or better yet, make up your own pledge showing your respect and honor for your country. Good luck.
P.S. 'It is school policy" does not circumvent the law or your rights. A school can't say "our policy is stronger that Federal law". For a school to set their own laws that attempt to supersede Federal law is illegal". Maybe you should stand, and just turn away from the flag? Oh by the way, I am not entirely supportive of your position, but your right to demonstrate your feelings and beliefs is what this is all about, and you are entitled to that.

Well for starters the Pledge of Allegiance has NOTHING to do with religion. The only area that can even remotely be considered religious is :One Nation under God; and that is not a religious statement. That is a statement that clarifies that our nation was founded under christian principals only. It does not imply that any one person believes or disbelieves in God, or a religious preference. Get Real. The Pledge is a oath of support to America. Second if your NOT a American and you don't like our customs please feel free to go to any other country you so desire. You see in America we stand for freedom and believe me when I tell you, WE DO NOT KEEP ANYONE IN THIS COUNTRY AGAINST THEIR WILL. Your 'rights' have not been violated and the school has every right to insist on you standing for the Pledge. Grow up and show some respect for the country you live in.
