DconS	If a person has AIDS and they spit on someone and the victim had an open wound in that area, i believe it could be considered such if it is their intent to possibly infect you (but what are the chances of that happening)-- just like a person who has AIDS and has sex with someone without protection without telling them has committed attempted murder. I think it has to do with intent, or if someone who had AIDS spits in someones food (attempted murder) and it is caught on camera. But also we have to realize that AIDS cannot be transmit by sitting down on a toilet seat after another person or by casual touching and hugging. It had to be direct fluid transfer whether by sexual insertion, fluid contacts, injections (whether accidental or not) etc. The skin is a great barrier unless it has been compromised!! sevenout7	yes and no, your chances of getting aids from someone spitting on you are very very slim, however if a person knowingly has aids and tries to bite, or spit on you, yes they can be charged with attempted murder whether or not they get convicted will be another story. technically if you were getting kissed and his tongue penetrated your mouth then it could be filed as a rape charge, but more than likely it will be sexually assault.
